Woman injured after car wreckPersonal injury protection is a required form of insurance in the state of Florida for drivers. In the event of injuries in an accident, personal injury protection (PIP) insurance will be billed.

Can I Get PIP Money for Medical Expenses?

If there are injuries in a vehicle accident, medical providers and hospitals have to bill PIP first. At that point in time, your individual deductible for that insurance will be applied to the total of the medical charges, too.

The majority of medical expenses will be covered by PIP insurance such as hospital fees, surgical service expenses, medication, ambulatory service costs, diagnostic services, and rehab costs.

How Much of My Expenses Will be Covered?

Under Florida law, only 80 percent of your medical expenses end up covered through the programs. Some people are able to cover the remainder of their medical bills with their personal health insurance policies.

If your injuries are severe, however, it’s also possible that you will have medical expenses that extend far beyond what is covered by PIP and your health insurance. In these cases, you might also have grounds for an individual claim against the other driver.

Does it Matter When I am Seen by a Doctor?

With PIP insurance in Florida, you need to be seen by a medical professional no later than 14 days after the accident. If you wait until after this period, you might not receive any PIP money for your medical expenses.

It’s also your responsibility not just to see the doctor as soon as possible, but to keep track of all of your expenses. Start a log as soon as possible after the accident. You could even receive reimbursement for the mileage you pick up going back and forth to your medical appointments.

What If My Injuries Cause Disability?

Florida PIP will cover up to 60 percent of your lost wages with a cap of $10,000. This payment can also extend to the support you need for services you’d otherwise be able to do, like cleaning the house, taking care of your pets, or doing laundry.

Your attorney can help you understand all the ways that you could use PIP money to help you adjust to life after your accident.

What Should I Do if My PIP Claim is Denied?

If your PIP claim is denied, it’s in your best interest to take action as soon as possible. Not every denial of a claim means that the person who filed it was not entitled to benefits. In fact, you could have the right to appeal that decision and fight back.

If some requirement was not met with the insurance company or if inaccurate information was applied to your claim, your request for PIP money could be denied. Your payout could also be denied if the company claims that you misrepresented something about your case.

What if My Loved One Was Killed?

If you lost a family member as a result of a serious car accident in Florida, PIP pays for burial and funeral expenses in addition to the above-mentioned payments. The next of kin family members could receive up to $5,000 for those related costs when a loved one passes away.

If you think you need support with your claim for PIP benefits, Top Class Actions can assist you with finding a lawyer who has the relevant experience.
