Target warranty class action overview: 

  • Who: An Arkansas man sued Target for violations of warranty laws.
  • Why: The plaintiff says Target does not provide customers with access to written warranties of items over $15 as it is required to do.
  • Where: The lawsuit was filed in an Arkansas court.

Target does not let customers know about the free manufacturer warranties of some items it stocks in the hopes consumers will buy Target’s own in-house warranty, a new class action lawsuit alleges.

Plaintiff Robert B Leflar filed the class action lawsuit against Target Corporation Aug. 15 in an Arkansas court, alleging violations of federal warranty laws.

Under the Magnuson-Moss Warranty Act, Leflar claims retailers must provide consumers with access to a written warranty for a product costing more than $15 prior to the point of sale.

“Despite these obligations under federal law, Defendant does not provide consumers with access to written warranties, prior to sale, in a manner that complies with the Pre-Sale Availability Rule,” the Target class action states.

Target class action alleges retailer’s actions self-serving

Leflar alleges that Target’s noncompliance has a self-serving motive. 

He says Target offers its own protection plan or extended warranty to consumers at the point of sale that provides coverage that is duplicative of the free manufacturer’s warranty that already comes with the product. 

“If the consumer is not made aware of this warranty, or is prohibited from learning of the warranty’s specific terms until after the point of sale, then he or she is more likely to buy Defendant’s duplicative ‘protection plan,'” the Target warranty lawsuit states.

Leflar says this happened to him in June when he purchased a laptop from Target that was subject to a warranty from the product’s manufacturer. 

“In the course of purchasing this product, Defendant did not make the product’s warranty available to Plaintiff or alert Plaintiff to the option of reviewing the product’s warranty,” the Target warranty class action claims.

Leflar looks to represent all Arkansas residents who purchased one or more products from Target that cost over $15 and that were subject to a written warranty. He also seeks certification of the class action, fees, costs and damages.

Meanwhile, Walmart and Target face a pair of class action lawsuits alleging they both place false and misleading advertisements on price displays and shelf signs.
