Persil detergent class action overview:

  • Who: Henkel Corp. is facing a class action lawsuit related to its Persil laundry detergent from plaintiff Miquel Ochoa-Cornman.
  • Why: Henkel is accused of falsely claiming that the liquid laundry detergent will complete 64 loads.
  • Where: The Persil detergent class action lawsuit was filed in Missouri state court in St. Louis County.

Henkel Corp. is facing a class action lawsuit related to false advertising claiming that it shorts customers on the 64-load claim on the front of the front of 100-fluid-ounce containers of Persil laundry detergent.

The Persil detergent package claims it can finish 64 loads but the fine print on the back of the container says that Line 1 on the cap is for “regular” loads and Line 2 is for “heavily soiled or large loads” according to the Persil class action.

“Because a laundry washing machine cannot be filled beyond full capacity, ‘large’ loads, as the product employs the term, must mean full loads of laundry (what consumers expect),” the class action says. “That being the case, it logically follows that a ‘medium’ load is something less than a full load of laundry.”

That means that customers would need 160 fluid ounces of Persil detergent to wash 64 large loads of laundry, the lawsuit claims.

Containers give 40% less Persil detergent than expected, class action lawsuit claims

The size of the container and expectation of medium loads compared to full loads means that customers get 40% less Persil detergent than they expect, the lawsuit claims.

Plaintiff Miquel Ochoa-Cornman is asking for a nationwide and Missouri subclass to be recognized and the court award compensatory damages, restitution, punitive damages and attorneys’ fees related to the Persil detergent class action.

A number of complaints were filed earlier this year against laundry detergent makers over claims revolving around false advertising and chemical-related issues, including one from an immunocompromised 5-year-old girl who died after coming in contact with The Laundress products that would end up being recalled over concerns they were contaminated with bacteria.
