Albertsons Signature Care Rapid Release Class Action Lawsuit Overview: 

  • Who: Renee Morgan filed a class action lawsuit against Albertsons Companies, Inc.; Safeway, Inc.; Better Living Brands, LLC; and LNK International, Inc.
  • Why: Morgan claims Albertsons falsely advertises that some of its Signature Care brand over-the-counter drugs are “Rapid Release.” 
  • Where: The class action lawsuit was filed in California federal court. 

Albertsons cheats its customers by falsely representing that some of its over-the-counter drugs, including analgesic or pain-relieving medicines with acetaminophen, are “Rapid Release,” a new class action lawsuit alleges. 

Plaintiff Renee Morgan claims the “Rapid Release” medicines sold under Albertsons’ Signature Care brand actually dissolve slower than non-rapid release branded acetaminophen products. 

“Since the release of the Class Rapid Release Gelcaps, Defendants have misled, and continue to mislead, consumers about the nature, quality and effectiveness of the Products through their advertising and labeling,” the Albertsons class action states. 

Morgan claims Albertsons intentionally sells its Signature Care brand “Rapid Release” acetaminophen drugs with “false, misleading, unfair, and deceptive labeling and marketing,” in order to “dupe” consumers into purchasing them for more than what they are actually worth. 

Albertsons Class Action Alleges Store Trying To Profit Off ‘Unwitting’ Consumers

“Defendants have pursued, and continue to pursue, this course of conduct in order to profit off of unassuming, unwitting consumers looking for the fastest pain-relief possible from an over-the-counter acetaminophen product,” the Albertsons class action states. 

Morgan argues that consumers such as herself would not have purchased the products had Albertsons “disclosed accurate information about the products” rather than mislead them into believing they would provide faster relief than other, less expensive options. 

Morgan claims Albertsons is guilty of unjust enrichment, breach of the implied warranty of merchantability and breach of express warranty and in violation of California’s Consumers Legal Remedies Act, Unfair Competition Law and False Advertising Law.

Morgan wants to represent a nationwide class and California subclass of consumers who have purchased Signature Care brand over-the-counter medicine containing acetaminophen and purporting to be “Rapid Release.” 

Plaintiff is demanding a jury trial and requesting injunctive and declaratory relief along with actual, compensatory, statutory and/or punitive damages for herself and all class members.

A consumer filed a similar class action lawsuit against Rite Aid in 2018, arguing the drugstore’s store brand acetaminophen gel tablets didn’t release as rapidly as advertised
