Simple Green all-purpose cleaner -  Simple green class action

UPDATE:

Consumers who purchased certain varieties of Simple Green All-Purpose Cleaner or other Simple Green products are eligible to claim a share in a $4.35 million class action settlement resolving claims the products are not non-toxic as advertised. Class Members may claim up to $30 without proof of purchase.

The Class consists of anyone who both purchased for personal use, and not for re-sale, one or more of the following Simple Green products in any size or packaging type between May 12, 2016, and May 17, 2021:

  • Simple Green All-Purpose Cleaner
  • Simple Green All-Purpose Cleaner (Fresh)
  • Simple Green All-Purpose Cleaner (Lemon)
  • Simple Green All-Purpose Cleaner (Lavender)
  • Simple Green Oxy Solve Total Outdoor Cleaner
  • Simple Green Oxy Solve House and Siding Cleaner
  • Simple Green Oxy Solve Concrete and Driveway Cleaner
  • Simple Green Oxy Solve Deck and Fence Cleaner
  • Simple Green Wash & Wax
  • Simple Green All-Purpose Wipes
  • Simple Green All-Purpose Wipes (Lemon)
  • Simple Green Multi-Purpose Foaming Cleaner
  • Simple Green Carpet Cleaner
  • Simple Green Marine All-Purpose Boat Cleaner
  • Simple Green Heavy Duty BBQ & Grill Cleaner
  • Simple Green Heavy Duty BBQ & Grill Cleaner (Aerosol)
  • Simple Green Oxy Dog Stain & Odor Oxidizer
  • Simple Green Bio Dog

In two class action lawsuits, plaintiffs alleged Sunshine Makers Inc., the maker of Simple Green cleaner, violated consumer protection laws by making claims on the products’ labels that the formulas used are “non-toxic.” The class action lawsuits claimed the plaintiffs were economically injured by those claims.

Simple Green is available in more than 100 countries and is distributed in the United States by companies such as Fastenal, Grainger, Unline, and others.

Sunshine Makers, headquartered in Huntington Beach, California, denies all allegations of wrongdoing.

The Court has not ruled in favor of either side in these cases, but the parties have agreed to a  settlement in order to avoid the costs and risks associated with continuing litigation.

Simple Green Class Action Settlement Benefits

Class Members submitting a valid claim form without a purchase receipt are entitled to a maximum refund of $3 per product purchased, up to 10 products, for a total of $30. These Class Members will not be entitled to any other refunds.

Class Members who are able to provide proof of purchase may claim $3 per covered product purchased, up to the total amount of units purchased that are submitted with proof of purchase.

The payment amounts may be reduced or increased proportionately depending on the total number of valid claims filed.

In addition to the monetary relief, Sunshine Makers has agreed to remove certain representations from the labels of the products covered by this settlement.

A final hearing in this settlement will take place Sept. 21, 2021. 

The deadline to opt out of or object to the settlement is Aug. 16, 2021.

Claim forms must be submitted by Aug. 16, 2021.

Who’s Eligible

The Class consists of anyone who both purchased for personal use, and not for re-sale, one or more of the following Simple Green products in any size or packaging type between May 12, 2016, and May 17, 2021:
