Entenmann’s class action lawsuit overview:

Bimbo Bakeries USA Inc. is facing a class action lawsuit alleging its Entenmann’s “All Butter” cake labeling deceptively implies that the flavor is derived only from butter when artificial ingredients actually contribute to the cake’s butter flavoring.

Plaintiff Dixie Ellison-Robbins says she paid more for Entenmann’s All Butter cake than she would have if she had known the “All Butter” claims were false and misleading, or she may not have purchased the product at all.

Ellison-Robbins alleges that she expected butter to be the main shortening ingredient and that the cake’s butter taste was derived only from butter.

Entenmann’s class action says company fails to disclose artificial ingredient contributes to butter taste

The Entenmann’s class action lawsuit notes that the product label prominently states “All Butter Loaf Cake” on the label. The Entenmann’s website reportedly entices consumers to “[i]ndulge yourself with the rich taste of pure butter in our All Butter loaf.”

Ellison-Robbins claims this labeling is misleading because Entenmann’s All Butter cake contains added artificial flavoring that contributes to the butter taste, but this information is not included on the front label.

Artificial flavors are listed in the back label’s ingredient list, but the specific artificial flavors are not indicated, according to the Entenmann’s class action lawsuit.

Laboratory testing has reportedly found that Entenmann’s All Butter cake contains artificial vanillin, which provides creamy and fatty sensations when used in foods. The plaintiff notes that numerous companies sell “pastry butter” or “bakers butter” which include a combination of butter and vanillin to create the buttery flavor and creamy sensation.

Federal and state regulations require products that contain added vanillin to simulate its characterizing butter flavor to state “Artificially Flavored” next to the “All Butter” claims on the label, the Entenmann’s class action lawsuit explains.

Ellison-Robbins notes that competitors truthfully disclose that their butter cakes are artificially flavored even when they are also made with real butter.

Because Entenmann’s fails to disclose that its butter cake derives its butter flavoring from artificial ingredients, it is able to charge a premium price for the allegedly mislabeled cake, the Entenmann’s class action lawsuit says.

Ellison-Robbins seeks to represent herself and a proposed class of Missouri residents who purchased Entenmann’s All Butter cake during the applicable statutes of limitations.

The Entenmann’s class action lawsuit asserts claims for violations of the Missouri Merchandising Practices Act, breach of warranty, negligent misrepresentation, fraud, and unjust enrichment.

In 2021, Bimbo Bakeries escaped a similar Entenmann’s All Butter cake class action lawsuit after a New York federal judge determined no reasonable consumer would assume the cake was made entirely of butter.
