Ensure nutrition drinks class action lawsuit overview:ย 

  • Who: Condalisa LeGrand and Larissa Bates filed a class action lawsuit against Abbott Laboratories.ย 
  • Why: LeGrand and Bates claim Abbott misleadingly represents that its Ensure nutrition drinks are healthy despite them adding up to 22 grams of sugar into them.ย 
  • Where: The class action lawsuit was filed in California federal court.ย 

Abbott Laboratories misrepresents that its Ensure nutrition drinks are healthy, despite their sugar content scientifically proving otherwise, a new class action lawsuit alleges.

Plaintiffs Condalisa LeGrand and Larissa Bates claim Abbott adds up to 22 grams of sugar into its Ensure nutrition drinks, in spite of advertising them as โ€œComplete, Balanced Nutrition for everyday health.โ€ย 

LeGrand and Bates argue Abbottโ€™s representations of its Ensure nutrition drinks as healthy are โ€œfalse and misleadingโ€ due to โ€œa vast body of scientific evidence demonstrating that consuming sugar sweetened beverages harms rather than supports overall health.โ€ย 

โ€œIn light of this sugar content and the scientific evidence, Abbottโ€™s representations that the Ensure Nutrition Drinks are balanced, nutritious, and healthy, are false and misleading,โ€ states the Ensure class action.ย 

LeGrand and Bates want to represent a nationwide class and New York and California subclasses of consumers who have purchased for personal or household use any of Abbottโ€™s Ensure nutrition drinks.ย 

Ensure nutrition drinks allegedly not healthy due to sugar content

LeGrand and Bates claim Abbott is guilty of unjust enrichment and intentional and negligent misrepresentation, and in violation of, among other things, New York General Business Law, and Californiaโ€™s Consumers Legal Remedies Act.ย 

Plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory and punitive damages for themselves and all class members.ย 

The U.S. Food and Drug Administration acknowledged last month that there were shortcomings in its response to the nationwide baby formula shortage caused by a bacterial contamination at an Abbott Nutrition factory.

    I gave my dying mother and step father(as well as the hospital) this every single day multiple times a day for meal replacements!!! I never wouldโ€™ve if I knew they were falsely advertising the benefits !

    After my heart failure I was told to watch my salt & sugar intake. I assumed by the advertising it would be the healthy direction to turn to. My mother was told by her Dr to drink ensures because of a digestive issue she was having. I can imagine now what this has contributed to her issue rather than help her. We would like to be added to this suit too!

    That was on my diet by a doctor at the mental hospital l didnโ€™t know that it was a lawsuit behind it. Does it matter what state that they gave it to you or where you at now on this lawsuit. I leave and go the the mental hospital in Alexander Louisiana. A l had the drink after my meds.

      We fed my mother in law Ensure every single day while she was struggling with dementia and her health just kept declining. That sugar was so bad for her and her brain.
