AriZona Mucho Mango Fortified Vitamin C Class Action Overview:

  • Who: AriZona Beverages is being sued by a consumer who bought its “Mucho Mango Fruit Cocktail” drink.
  • Why: The consumer says AriZona markets the drink as being “Vitamin C Fortified” but alleges these claims are misleading.
  • Where: The lawsuit was filed in Illinois and seeks to represent consumers from multiple states.

Beverage behemoth AriZona is deceptively marketing its “Mucho Mango Fruit Cocktail” drink to consumers, a new class action lawsuit seeking more than $5 million in compensation alleges.

Plaintiff Dawn Hancock filed the class action lawsuit against AriZona Beverages USA LLC on Dec. 22 in an Illinois court, alleging violations of state and federal consumer laws. 

AriZona makes and sells mango drinks under the name “Mucho Mango Fruit Cocktail.” On the label, there are pictures of mangos and the text “Vitamin C Fortified,” Hancock says.

However, this marketing is deceptive for consumers because it implies the product has more vitamin C than other similar products, the lawsuit says.

“The Product does not list any reference food, and consumers are not told the basis for the Product’s claim to be ‘fortified with Vitamin C,’” Hancock alleges. “Fortification of the Product is deceptive, causing consumers to purchase it instead of other products, which are consistent with dietary guidance.”

She says FDA regulations restrict nutrient content claims to those that are specifically authorized. If a nutrient content claim is not authorized, it is prohibited, she alleges.

“The purpose is to prevent consumers being deceived by the endless terms that marketers can devise in order to gain advantage in the marketplace, at the detriment of the public,” the lawsuit states.

Plaintiff Says She Expected Juice To Contain More Vitamin C Than Similar Beverages

Hancock says she bought the juice from a Walmart because she expected it to contain more vitamin C than similar beverages.

She’s looking to represent an Illinois class of people who bought the juice, plus a multistate class of consumers in Ohio, Michigan, Nevada, Arizona, Rhode Island, North Dakota, Oregon, Texas, Iowa, Kansas, Virginia, Tennessee, New Hampshire, Maine, Alaska, South Dakota and Oklahoma.

Hancock is suing under state consumer laws and for breach of warranty, negligent misrepresentation, fraud and unjust enrichment. 

The lawsuit is seeking certification of the class, an injunction, damages, fees, costs and a jury trial. It states that the aggregate amount in controversy exceeds $5 million. 

AriZona is one of the largest sellers of non-carbonated beverages in the country, and the juice is available online and in almost every convenience store, grocery store, big box store and drug store in Illinois.

The company is also currently facing a class action lawsuit alleging AriZona ice tea is deceptively marketed as “All Natural” when it contains added coloring.
