Unum-long-term-disabilityUnum Life Insurance Company of America is facing a new claim denial lawsuit after allegedly denying a man long term disability (LTD) benefits for insufficient reasons.

The claimant alleged his LTD benefits were denied under illegal circumstances as the insurance company denied his claim even though he met all requirements for eligibility.

Florida plaintiff James S. was previously fully employed by Phoenix Safety & Logistics Personnel Inc., which had guaranteed him a salary and LTD benefits on Nov. 1, 2014. Even though he was employed by the company and had performed all occupational duties expected of him, James was allegedly denied LTD benefits when he needed them.

According to the claim denial lawsuit, James became totally disabled on Oct. 23, 2015, due to his epilepsy and all the severe symptoms that came with the condition. James filed an application for LTD benefits on Jan. 20, 2016, during which he followed all administrative procedures when filing this claim and filed all necessary medical paperwork.

Overview of Unum Claim Denial of LTD Benefits

Under Unum’s insurance policy, policyholders can be eligible for LTD benefits if the person can no longer perform their occupational duties and will be unable to continue to work in a similar job. In addition, the policyholder must prove that they lost a significant portion of their income due to their disability.

Under the terms of eligibility for Unum LTD, James met all requirements and promptly filed to receive coverage. However Unum reportedly denied LTD benefits to James on June 29, 2016, even though James reportedly met all of the insurance company’s requirements to be eligibility for benefits.

James promptly filed an appeal on Dec. 23, 2016, but was met with the same result. It is important to note that James continues to suffer from epilepsy and severe seizures, which has made him unable to work or earn a sufficient income.

In addition James will most likely be unable to ever work in a similar occupation but will continue needing medical assistance for his condition. At this point in time, James has exhausted all administrative remedies and has been forced to resort to legal action.

James is filing this claim denial lawsuit alleging Unum denied him LTD benefits under unfair circumstances and did not have sufficient reason to make their decision. James is seeking all missed LTD benefit payments along with any additional damages.

This Claim Denial Lawsuit is Case No. 3:17-cv-00162-RV-CJK, in the U.S. District Court for the Northern District of Florida, Pensacola Division.
