3M, Solvay forever chemicals lawsuit overview:ย
- Who: Charles R. Walzer and Rae B. Walzer filed a lawsuit against Solvay Specialty Polymers USA LLC, The 3M Company and DuPont, among others.ย
- Why: The Walzers claim Solvay, 3M and DuPont knowingly and intentionally discharged harmful chemicals, including per- and polyfluoroalkyl substances, into the environment.ย
- Where: The lawsuit was filed in New Jersey federal court.ย
Chemical companies, including Solvay, 3M, and DuPont, have knowingly and recklessly discharged harmful chemicals that contaminated soil, water and air and caused birth defects and illnesses, a new lawsuit alleges.ย
Plaintiffs Charles R. Walzer and Rae B. Walzer claim the chemical companies put public health at risk by allegedly intentionally discharging per- and polyfluoroalkyl substances (PFAS), among other harmful chemicals.ย
The Walzers, who reside in New Jersey, argue they, along with their child Carrie R. Walzer,ย suffer from a number of health issues as a result of the companies allegedly releasing the so-called โforever chemicalsโ into the environment.ย
โPlaintiffsโ injuries were foreseeably caused by Defendantsโ misconduct, including their intentional manufacturing, use, discharge and/or disposal of toxic and dangerous chemicals,โ the 3M and Solvay lawsuit states.ย
The Walzers claim they have lived near Solvayโs West Deptford facility in Pedricktown, New Jersey, since 1980, exposing them to chemicals through contaminated air, soil, groundwater and drinking water near the plant.ย
The family also lives near DuPont and Chemoursโ Chambers Works in Pennsville and Carneyโs Point townships, according to the lawsuit.ย
Chemical companies knew, or should have known, about harmful PFAS effects, lawsuit claims
The Walzers argue exposure to โtoxic and dangerousโ chemicals Solvay, 3M and DuPont allegedly dumped caused Carrieโs developmental disabilities and Rae to suffer a miscarriage and breast cancer.ย
โDuPont and 3M committed acts and omissions with respect to PFAS and other toxins with actual malice and/or with a wanton and willful disregard of people who foreseeably might be harmed by those acts or omissions,โ the forever chemicals birth defects lawsuit states.ย
The chemical companies either knew or should have known for decades that PFAS and other chemicals are highly toxic and have the ability to cause harm to consumers, the lawsuit alleges.ย
โDespite that knowledge, Defendants continued to use PFAS and other toxins in products and release them into the environment,โ the lawsuit states.ย
The Walzer family demands a jury trial and requests compensatory and punitive damages โas a consequence of the personal injuries they have suffered.โย
PFAS have faced increased scrutiny in the past few years. Just recently, the U.S. Environmental Protection Agency proposed a new rule aimed at limiting the amount of forever chemicals in drinking water.ย

The plaintiffs are represented by Steven Phillips, Victoria Phillips, Russell Curley and Marc C. Gorrie of Phillips & Paolicelli LLP; Peter A. Kraus and Michael Connett of Water, Kraus & Paul; and Kevin Cooney of Cooney & Conway.ย
The 3M and Solvay forever chemicals class action lawsuit is Walzer, et al. v. Solvay Specialty Polymers USA LLC, et al., Case No. 1:23-cv-04174, in the U.S. District Court for the District of New Jersey.

4 thoughts onFamily files โforever chemicalsโ lawsuit against 3M, Solvay over birth defects, illness
My dad was a 30 year Seabee navy reservist. He had prostate cancer and still has to take medication for the after affects.
I worked for Solvay here in Anaheim, CA. Their practices are definitely criminal. We were told to lie during government audits. Our lab testing were fixed to make it look like materials were passing, but they were out of spec. Theyโve put employees in danger on many occasions all while trying to make a quota. There was a chemical leak in our department and we were told to just wear full face respirators for the entire 12hr shift. Letโs not mention how we did confined space work in an oven with toxic gases with no supervisor present. No lockout tag out checks etc smh. I could go on and on and on. I hope this company is brought to justice and they pay dearly.
The chemicals have been linked to a host of physical ills, including decreased fertility, high blood pressure in pregnant people, increased risk of certain cancers, developmental delays and low birthweight in children, hormonal disruption, high cholesterol, and reduced effectiveness of the immune system. These animal studies have found that PFAS can cause damage to the liver and the immune system. PFAS have also caused low birth weight, birth defects, delayed development, and newborn deaths in lab animals. Some of the most common types of chemical birth defects include cleft lip or cleft palate, missing or underdeveloped organs, and missing or deformed limbs, as well as deformities of the spine and brain.
They need to be SHUT DOWN! My first son suffered from low birth weight! Please contact me as I would like to be apart of this claim
