A federal judge recently granted final approved to a $9.75 million Nexus class action settlement resolving claims that the Google and Huawei smartphones were defective.
In addition, U.S. District Judge Beth Labson Freeman approved $3 million in attorneys’ fees – representing 30 percent of the total $9.75 million settlement fund that Girard Sharp LLP and Chimicles Schwartz Kriner & Donaldson-Smith LLP negotiated with Google and Huawei.
Although attorneys’ fees in class action lawsuits usually start at 25 percent of a settlement fund, Judge Freeman approved the higher award based on the attorneys’ performance during litigation.
“Counsel are experienced in the prosecution of consumer class actions, and ‘[s]uch expertise proved particularly beneficial in this action, in view of the substantive and procedural complexities involved in litigation and the protracted settlement process,’” Judge Freeman ruled. “The quality of their work is reflected in the results achieved for the class.”
The law firms negotiated the nearly $10 million Nexus class action settlement with Google and Huawei – reaching a resolution in April. By paying this hefty sum, the companies resolve claims that Nexus 6P smartphones were defective – allegedly resulting in poor battery performance and trouble with spontaneous rebooting.
Google and Huawei have not admitted any wrongdoing by settling the renexus class action claims against them.
Under the Nexus class action lawsuit settlement, thousands of consumers will be able to recover compensation for the allegedly defective smartphones. The $9.75 million renexus class action settlement reportedly equals almost one third of the damages the buyers may have recovered from a judgement.
In addition to approving the attorneys’ fees to be deducted from the re nexus 6 lawsuit settlement, Judge Freeman recently approved more than $150,000 in court costs and $3,000 service awards for each of the 13 named plaintiffs.
The remaining $6.6 million Nexus class action settlement fund will reportedly be split between around 67,000 Class Members who filed valid claims with the settlement.
Class Members who participate in the renexus class action settlement will reportedly be able to recover payments between $5 and $400. Payment amounts will depend on the defects experienced by each Class Member.
If Class Members provided documentation with their claims, they will reportedly be able to collect up to $325 for the bootloop defect and up to $150 for the battery drain defect. If Class Members experienced the defect on more than one Nexus 6P smart phone, they will reportedly be awarded up to $400.
Without documentation, re nexus 6 lawsuit payments will reportedly be smaller – between $10 and $75 depending on the defect. If a Class Member did not experience any defects, they will reportedly be awarded between $5 and $10.
The deadline to file a claim with the Nexus 6 lawsuit settlement was Sept. 3, 2019.
