  • Lenovo Inc. seeks dismissal of a class action lawsuit accusing the global tech company of selling an allegedly defective desktop computer model.
  • Lenovo claims the complaint is “the latest vexatious litigation” to be filed by Spencer Sheehan of Sheehan & Associates P.C., which they argue has filed more than 400 putative class actions since 2020.
  • The judge ordered the consumer behind the class action lawsuit to either file an amended complaint within 21 days time or respond to Lenovo’s motion to dismiss. 
  • The consumer claims Lenovo misled its customers about the reliability of its Legion T5 desktop model, arguing it regularly freezes despite being marketed for its supposed high performance. 

Lenovo desktop class action lawsuit overview:

  • Why: Dinwiddie claims Lenovo manufactured and sold Legion T5 28IMB05 desktop computers containing hardware and software defects that cause them to frequently freeze and/or crash.

Lenovo manufactured and sold Lenovo Legion T5 28IMB05 desktop computers containing hardware and software defects that cause the device to frequently freeze and/or crash, a new class action lawsuit alleges. 

Plaintiff Josh Dinwiddie claims Lenovo misleads consumers who expect the Lenovo desktop computer to “function reliably for games, graphic design and other everyday use without freezing or crashing.” 

Dinwiddie argues the affected Lenovo desktop computers contain NVIDIA audio and graphics drivers believed to be incompatible with the desktop’s other drivers, software and components. 

“While temporary options have been proposed including re-installing the relevant drivers, a permanent solution has not or took significant amounts of time to materialize,” the Lenovo class action states. 

Lenovo class action claims company failed  to categorize alleged issue as defect

The alleged defect is “especially frustrating” for affected users since Lenovo has failed to categorize the issue as a defect, preventing them from being able to get warranty coverage to fix it, the lawsuit states.

“Consumers expect a computer represented – directly or indirectly – as capable of functioning reliably, not freezing or crashing, and running smoothly during operation, to act as promised,” the Lenovo class action states.

Dinwiddie wants to represent a Michigan class and multistate consumer fraud class of individuals who have purchased a Lenovo Legion T5 28IMB05 desktop computer during the statute of limitations. 

He accuses Lenovo of unjust enrichment, negligent misrepresentation and fraud and of violating multiple state consumer fraud acts, including the Magnuson Moss Warranty Act and the Michigan Consumer Protection Act

Dinwiddie demands a jury trial and requests declaratory and injunctive relief along with an award of monetary, statutory and/or punitive damages for himself and all class members. 

A consumer filed a separate class action lawsuit against Lenovo in June, arguing the company uses fake valuations for its desktop and laptop computers to offer discounts on its website that appear greater than they actually are.

    I purchased a Lenovo t5 desk top and it kept freezing up or crashing and failing to restart on command a waste of money computer that don’t work just look at it can’t use it please add me

    lENOVO IDEA CENTER 5I-i HAD NOTHING BUT TROUBLE WITH FREQUENT CRASHES i HAD SENT IT IN 3 TIMES FOR REPAIR AND THE PROBLEM STILL EXISTS. tHE COMPANY HAD FAILED TO GIVE ME MY MONEY BACK, i ASKED FOR MY MONEY BACK OR A SUITABLE REPLACEMENT BUT FAILED. fEDERAL LEMON LAWS REQUIRES A COMPANY TO SATISFY OR RESOLVE THE ISSUE SO NOW i HAVE TO CONTACT THE ATTORNEY GENERAL. THE CUSTOMER SERVICE SUCKS, THEY CAN CARE LESS. i WILL NEVER PURCHASE ANOTHER LENOVO PRODUCT AGAIN.

    I have a Lenovo IdeaPad gaming 3 that has had two motherboards crap out in the 6 months I have owned it. Never have I owned such an unreliable laptop. This suit needs to be expanded!

    I purchased this product back in Dec of 2021 it was working fine for the first couple of months then I started to notice it acting a bit lower and then it started to freeze up on me. I didnt know much about computers at the time so all I did was restart and it would get fixed. Then after the warranty expired the computer went to shit , keep giving me the same error messages, wouldnt let me inside the pc and completely turned into a brick. Took the computer to multiple people and shops but no one could find a solution, now that I found out that there isnt a way to fix this Im extremely upset, I spent so much time and money trying to figure out the issue just to find out that it cant be fixed because Lenovo doesnt have a fix for it. Bought my Lenovo T5 model gaming PC at best buy thinking that was the best option, clearly it wasnt.

    I have a very similar model (Legion T5-26IOB6) that has been experiencing the exact same issues since I purchased it in December 2022. This PC has high end specs, but since the 2nd day I got it, has done nothing but BSOD and crash during a variety of different uses. I’ve already shipped it back to lenovo for repair. Upon getting it back, they stated their solution was to reinstall and fix windows OS. Within 2 hours of booting the PC back up after receiving it back, the blue screen crashes began again. It does not matter what settings i modify, drivers i update or rollback, or what forum I follow steps to; nothing has resolved this issue, so I would greatly like to be added to this is it’s still a possibility. I have had plenty of PC’s in my life, and never once experienced madness like this. My other gaming laptop (msi), I’ve had for 3 years now, and not once has it had a crash. This is honestly unacceptable, that these legion t5 models are still being sold on countless websites and in store locations knowing the problems they seem to have across the board.

    Pls add me to this! I have a lenovo laptop and I’ve been having troubles with it and after the warranty now it doesn’t work the right way unless you buy MacAfee product from microsoft and its expensive. plus i don’t use microsoft to many hacking with them people

    I’m also in the same boat with this model. The crashing seems to have gotten worse lately too.
