Update:

  • Lenovo Inc. seeks dismissal of a class action lawsuit accusing the global tech company of selling an allegedly defective desktop computer model.
  • Lenovo claims the complaint is “the latest vexatious litigation” to be filed by Spencer Sheehan of Sheehan & Associates P.C., which they argue has filed more than 400 putative class actions since 2020.
  • The judge ordered the consumer behind the class action lawsuit to either file an amended complaint within 21 days time or respond to Lenovo’s motion to dismiss. 
  • The consumer claims Lenovo misled its customers about the reliability of its Legion T5 desktop model, arguing it regularly freezes despite being marketed for its supposed high performance.

Lenovo manufactured and sold Lenovo Legion T5 28IMB05 desktop computers containing hardware and software defects that cause the device to frequently freeze and/or crash, a new class action lawsuit alleges. 

Plaintiff Josh Dinwiddie claims Lenovo misleads consumers who expect the Lenovo desktop computer to “function reliably for games, graphic design and other everyday use without freezing or crashing.” 

Dinwiddie argues the affected Lenovo desktop computers contain NVIDIA audio and graphics drivers believed to be incompatible with the desktop’s other drivers, software and components. 

“While temporary options have been proposed including re-installing the relevant drivers, a permanent solution has not or took significant amounts of time to materialize,” the Lenovo class action states.

The alleged defect is “especially frustrating” for affected users since Lenovo has failed to categorize the issue as a defect, preventing them from being able to get warranty coverage to fix it, the lawsuit states.

“Consumers expect a computer represented – directly or indirectly – as capable of functioning reliably, not freezing or crashing, and running smoothly during operation, to act as promised,” the Lenovo class action states.

Dinwiddie wants to represent a Michigan class and multistate consumer fraud class of individuals who have purchased a Lenovo Legion T5 28IMB05 desktop computer during the statute of limitations. 

He accuses Lenovo of unjust enrichment, negligent misrepresentation and fraud and of violating multiple state consumer fraud acts, including the Magnuson Moss Warranty Act and the Michigan Consumer Protection Act

Dinwiddie demands a jury trial and requests declaratory and injunctive relief along with an award of monetary, statutory and/or punitive damages for himself and all class members. 

A consumer filed a separate class action lawsuit against Lenovo in June, arguing the company uses fake valuations for its desktop and laptop computers to offer discounts on its website that appear greater than they actually are.

    Same Story here. My Desktop I bought in Nov of 2022, crashes 2 to 3 times a day. I just bought more ram too, hoping this might solve the issue. I spent so long researching the best computers and ultimately chose this one because of its upgradability. I would love to sue these bastards!

    I’d like to join. I purchased the system in question (T5-28IMB05) in August of 2021 through Newegg, and it has been a recurring waking nightmare ever since. Similarly to other commenters, I’ve had countless unhelpful calls with Lenovo support, and have been told I cannot get a refund or replacement for the machine despite its inherent defects. It is apparently a “known problem” with the model, but support does not seem to understand that the problem recurs regardless of their suggested “fix” of uninstalling and reinstalling the Nvidia graphics driver. The unit cost me over $1,000, a value I cannot simply count as a loss and replace. I don’t have that kind of money. Working on my PC is integral to my lifestyle, and Lenovo’s product has made my life much more difficult since my regrettable purchase.

    Have dead T5-AMR25 leigon gaming desktop. Lasted just over 12 months.

    Wasted so much time on this… Oregon here Costco warehouse buyer… crashes with problems with incompatible audio drivers… something with the motherboard I guess. No fix.

    I purchased a Legion T5 28IMB05 and yes have the freezing issues at least once a day. My friend also purchased one at about the same time and he has same issues.

    I purchased a Lenovo T5 model gaming PC in December of 2020, and I have had these drivers/freezing issues on and off ever since my purchase. I have exhausted hours of time on the phone with their customer service team, who run the same useless tests every time. I am just told that it is a known issue with this model, and that I am unable to update my graphics drivers at this time. Fast forward almost 3 years later, and games are now requiring updates that my PC will no longer satisfy, so my catalog of games is shrinking as time goes on. Lenovo refuses to replace items, getting a supervisor or manager on the phone is near impossible. I am not tech savvy, but I asked if replacing the graphics drivers myself would fix the issue, and they would not answer the question, just saying that it would break my warranty and advised against it. 100% at the end of my rope. I purchased this PC through Costco Wholesale, so I am communicating with member services and filing a formal plea to reconsider Lenovo as a partner. They knowingly sold defective products through a wholesaler, so I wanted them to be in the know regarding this. Not sure if this is the place to request this, but please add me to this so we can maybe get some closure here. Either way, I will do what I can to foil their Costco contract LOL

    I own this system, and it is horrible. All the issues he claims are verifiable and justified. Sign me up. A quick google search will show you hundred if not thousands with the same issues on this exact model, the T5-28IMB05. I tried with no success to go through Lenovo warranty as well as Costco warranty, which is where it was purchased. I just want this thing gone so that I can replace it, but who in this economy can shell out an additional $1000 or more to replace a product they just purchased for $1000 a year ago? I know I can’t do it.

      Also bought mine through Costco. I have made them aware of the fact that Lenovo is knowingly selling defective products and through their warehouses. Knowing their business model and how they always try to do what is right by the member, I think we will get somewhere there. Probably not replacements or refunds, but maybe at least some justice by ruining Lenovos contracts with Costco Buyers. Fingers crossed :)
