Update:

  • Lenovo Inc. seeks dismissal of a class action lawsuit accusing the global tech company of selling an allegedly defective desktop computer model.
  • Lenovo claims the complaint is “the latest vexatious litigation” to be filed by Spencer Sheehan of Sheehan & Associates P.C., which they argue has filed more than 400 putative class actions since 2020.
  • The judge ordered the consumer behind the class action lawsuit to either file an amended complaint within 21 days time or respond to Lenovo’s motion to dismiss. 
  • The consumer claims Lenovo misled its customers about the reliability of its Legion T5 desktop model, arguing it regularly freezes despite being marketed for its supposed high performance.

  • Where: The class action lawsuit was filed in Michigan federal court.

Lenovo manufactured and sold Lenovo Legion T5 28IMB05 desktop computers containing hardware and software defects that cause the device to frequently freeze and/or crash, a new class action lawsuit alleges. 

Plaintiff Josh Dinwiddie claims Lenovo misleads consumers who expect the Lenovo desktop computer to “function reliably for games, graphic design and other everyday use without freezing or crashing.” 

Dinwiddie argues the affected Lenovo desktop computers contain NVIDIA audio and graphics drivers believed to be incompatible with the desktop’s other drivers, software and components. 

“While temporary options have been proposed including re-installing the relevant drivers, a permanent solution has not or took significant amounts of time to materialize,” the Lenovo class action states.

The alleged defect is “especially frustrating” for affected users since Lenovo has failed to categorize the issue as a defect, preventing them from being able to get warranty coverage to fix it, the lawsuit states.

“Consumers expect a computer represented – directly or indirectly – as capable of functioning reliably, not freezing or crashing, and running smoothly during operation, to act as promised,” the Lenovo class action states.

Dinwiddie wants to represent a Michigan class and multistate consumer fraud class of individuals who have purchased a Lenovo Legion T5 28IMB05 desktop computer during the statute of limitations. 

He accuses Lenovo of unjust enrichment, negligent misrepresentation and fraud and of violating multiple state consumer fraud acts, including the Magnuson Moss Warranty Act and the Michigan Consumer Protection Act

Dinwiddie demands a jury trial and requests declaratory and injunctive relief along with an award of monetary, statutory and/or punitive damages for himself and all class members. 

A consumer filed a separate class action lawsuit against Lenovo in June, arguing the company uses fake valuations for its desktop and laptop computers to offer discounts on its website that appear greater than they actually are.

    I just purchased last week and it sucks to say that it’s slow because I had such pride in buying it. I spent probably more than 30 hours comparing prices and checking benchmarks for cpu gpu ssd and finally picked this one and I’m left wondering if I have a virus because of how slow it gets. It’s the i7 11 gen. 8 core with the RTX 3060. It should be plenty fast for just surfing the web. But it’s been real slow….

    Their tablets are no good either I made the mistake of buy one and it doesn’t work well at all its slow and freezes up.

    I have a Lenovo desktop that has never worked correctly. It would turn off on it’s own, and it consistently takes at lease 20 minutes or more to be able to use the t 5 computer has problems

      Purchased from Wal-Mart $200 with a warranty for my grand daughter during the pandemic for home schooling it shuts down in the middle of her lesson:( I have a full receipt and warranty But it still never worked

    Purchased the Lenovo laptop from Best Buy in Florida in April, 2021. Hasn’t worked right since.

      I purchased the Lenovo desktop in October 2021 and a glitch in the touch screen left the computer unusable while touch screen was enabled. After reaching out to Lanovo In August/September of 2022, They said the only way they would fix it, was if I purchased the extra Warrenty. They stated my original Warrenty would expire in one month, not offering enough time to ship me the labels so I could in turn, ship it back to them to be fixed. After purchasing the extra warranty they were to send me a shipping label to return the computer to a Texas location for repairs. The shipping label never came. I then received an email stating my Warrenty (expiring 10/23) was already expired. I’m still having issues with the hard drive and can not properly use my computer. After reading other reviews I had concerns of shipping the computer to them as it took weeks/months to get it back and most reported the computer was still broken. Very upset and disappointed in this company.
