A $7.2 million computer tech support settlement has been reached to resolve claims that a Bank of America subsidiary violated Florida state laws.
The computer tech settlement benefits individuals who paid for computer tech support products or services over the phone between March 1, 2015 and July 1, 2017. Under the terms of the settlement, eligible consumers can recover a cash payment.
The Florida attorney general filed claims against several computer tech companies – accusing them of misleading consumers and tricking them into purchasing computer tech support products or services over the phone.
“Posing as legitimate businesses,” the computer tech support companies allegedly entered into merchant services contracts using information that altered or obscured the “nature of their services and operations,” the settlement agreement notes.
According to the Florida attorney general, Banc of America Merchant Services LLC provided payment processing services to various computer tech companies. By assisting the computer tech companies, the payment processor allegedly violated both the Telemarketing Sales Rule in Florida and the Florida Deceptive and Unfair Trade Practices Act.
As a result of these practices, consumers reportedly sustained financial harm. The Attorney General sought monetary damages from involved parties in order to refund consumers who were involved in the scheme.
Banc of America has not admitted any wrongdoing in associated with the Florida AG’s claims, but has agreed to resolve the claims against them in a $7.2 million settlement deal.
Under the terms of the settlement, eligible Class Members can collect cash refunds. Refund amounts will vary depending on the number of valid claims filed but will compensate consumers for the amount they paid for purported computer tech support products or services between March 1, 2015 and July 1, 2017.
In order to benefit from the computer tech class action settlement, Class Members must file a valid claim form by Oct. 2, 2020. A claimant ID number – received via a mailed notice from the AG – is required to file a claim online.
Who’s Eligible
Individuals who paid for computer tech support products or services over the phone between March 1, 2015 and July 1, 2017.
Potential Award
Cash refunds.
