Female with an Electronic CigaretteA JUUL user says that she suffered two serious seizures because of her e-cigarette use, and has filed a lawsuit aiming to hold JUUL Labs Inc. and Altria Group liable for her injuries.

The JUUL seizures lawsuit was filed by Kimberly Mays. She says that she suffered two “devastating” seizures immediately after using a JUUL e-cigarette. Allegedly, these seizures have left her dependent on others for her care. She says that JUUL Labs field to warn her of the possible health hazards of JUUL, and this failure resulted in her injuries.

This lawsuit comes amidst increasing concern over the health impacts of e-cigarette use, whose popularity has exploded over the last decade.

Mays claims that as early as May 2019, she saw JUUL’s advertisements of its products, and was attracted to them as smoking cessation tools. She says that between April 2019 and July 2019, she purchased JUUL’s products, in the Virginia tobacco flavor.

The JUUL seizure lawsuit says that when she first started using JUUL e-cigarettes, she was not aware of the possible health hazards of JUUL like seizures, strokes, and other serious injuries. May claims that if she had known that the products could cause these problems, she would not have begun to use them.

Allegedly, the JUUL products were not effective as a smoking cessation tool, because May used the JUUL regularly, possibly even more than she smoked cigarettes.

The health hazards of JUUL lawsuit says that May had the first seizure in June 2019, less than 30 minutes after using the e-cigarette. She says that this seizure had occurred after she had used the JUUL for around two months. She says that she had to be hospitalized because of the seizure.

Allegedly, she suffered a similar seizure in July 2019, under 30 minutes after using her JUUL. She says that the second seizure was also so severe that she had to be hospitalized. May says that after the second seizure, she stopped using JUUL.

However, the JUUL lawsuit says that she still suffers the effects of JUUL use — allegedly, May has had multiple seizures, was diagnosed with short-term memory loss, mood shifts, and what the JUUL lawsuit describes as a “permanent altering of her brain.”

The JUUL seizures lawsuit says that JUUL marketed e-cigarettes as smoking cessation tools and designed them as electronic cigarettes in order to get around regulations that limit e-cigarettes. Allegedly, they are marketed as less harmful than cigarettes but in reality, deliver high nicotine levels and are highly addictive.

Business Insider says that a hit of JUUL delivers as much nicotine as a pack of cigarettes. 

According to the JUUL lawsuit, JUUL “learned how to manipulate the nicotine in its products to increase sales,” making the devices easy to smoke without the irritation to the throat characteristic of cigarettes. Allegedly, this ease of use, in conjunction with the many appealing flavors, made the devices attractive to vape users.

May argues that JUUL intentionally misled customers into believing that the devices were less dangerous than they are in the interest of profits, at the expense of customer health.

The JUUL Seizure Lawsuit is Case No. 2:19-cv-01268-NR, in the U.S. District Court for the Western District of Pennsylvania.
