A multidistrict litigation panel recently heard from dozens of lawyers who are filing lawsuits against the e-cigarette giant Juul Labs over juuling health effects, as the panel determines which judge should hear the cases going forward.
Approximately 55 individual lawsuits against Juul, filed by plaintiffs all over the country, were brought in front of the MDL panel.
Lawyers referred to the litigation as “massively complex” and “growing more complex day by day.”
Lawyers for the plaintiffs involved made their arguments to advocate for various judges they believe should hear the cases. Though some prefer certain judges over others, they agree that the pile of Juul-related cases is too massive to be divided.
Lawsuits allege that Juul’s marketing was misleading, and failed to disclose to consumers the nicotine in its products, leading to problems with youth addiction. Others are personal injury lawsuits filed over specific juuling health effects like pulmonary disease, seizures, and other significant health problems.
This MDL panel comes in the wake of Juul announcing that its CEO, Kevin Burns, would step down effective immediately according to CNN. Burns will be replaced by K.C. Crosthwaite, formerly the chief growth officer at Altria, a tobacco company, which is a major Juul investor.
Juul had in recent months been struggling with the growing number of reports of deaths tied with vaping and e-cigarettes across the country.
Because of the reports of vaping-related deaths, some companies have decided to stop selling e-cigarettes altogether. Juul, facing growing pressure from the U.S. Food and Drug Administration (FDA) as it investigates the company’s marketing tactics with children, has stated that it plans to stop advertising across TV, print, and digital platforms for the time being.
“I have long believed in a future where adult smokers overwhelmingly choose alternative products like Juul,” said Crosthwaite, according to CNN. “Unfortunately, today that future is at risk due to unacceptable levels of youth usage and eroding public confidence in our industry. Against that backdrop, we must strive to work with regulators, policymakers and other stakeholders, and earn the trust of the societies in which we operate.”
According to the FDA, vaping has become an epidemic among young people today. Indeed, between 2017 and 2018, youth usage increased by 80 percent among high school students, and by 48 percent among middle school students.
