A Minnesota woman recently filed a Unum lawsuit against First Unum Life Insurance Company after the company denied her disability insurance claim.
According to the lawsuit, plaintiff Jennifer M. was an employee for Thomas Reuters Holding, Inc., which offered income protection to employees in the event of a disability.
After Jennifer became disabled in February 2014, she filed a disability insurance claim according to her company’s plan managed by Unum, but was denied.
Jennifer responded by appealing this decision on an administrative level in June 2015 in the hopes that her disability insurance claim would be accepted.
This first appeal was denied by Unum, so Jennifer sought to appeal again in March 2016. The disability insurance claim appeal was again denied.
The denial of her disability insurance claim came despite Jennifer allegedly providing substantial medical evidence showing her eligibility for a disability insurance claim.
The lawsuit alleges that this disability insurance claim denial and denial of subsequent appeals was unfair, given the plaintiff’s legitimate disability. Indeed, the lawsuit claims, “First Unum Life Insurance Company’s interest in protecting its own assets influenced its decision to deny Plaintiff’s application for disability benefits.”
After exhausting her administrative appeals, Jennifer still had one path forward to pursue her disability insurance claim: litigation against Unum.
Jennifer filed her disability insurance claim lawsuit, alleging that Unum violated its contract and unfairly denied her disability insurance claim. The lawsuit requests reimbursement, attorneys’ fees and recognition of the benefits to which she is entitled.
Unum’s Practice of Denying Disability Insurance Claims
Unum Life Insurance Company of America, or Unum, is the single largest disability insurance company in the country.
A growing number of plaintiffs are filing disability benefits lawsuits against Unum, claiming that the insurance giant unfairly denied their claims to benefits that they qualify for under the terms of their insurance policies.
This Unum lawsuit denied disability benefits and other similar lawsuits allege that Unum, as the largest disability insurance company in the country, has unfairly denied the disability insurance claims of plaintiffs who are qualified to receive such benefits.
Some lawsuits go further, alleging that the company purposely denied the claims of hundreds of thousands of workers with legitimate disabilities for no reason other to increase company profit.
Former employees of Unum have reported being instructed to purposely deny insurance to people with legitimate claims to disability benefits in order to fulfill the company’s quota.
Consumers who have exhausted all recourse through applications and appeals for disability benefits may turn to filing a lawsuit over denied disability benefits, hoping to reverse Unum’s denial.
If you or someone you know has been denied their proper disability benefits by Unum Life Insurance Company of America, you may be able to file a Unum lawsuit over denied disability benefits.
The Unum Disability Insurance Claim Lawsuit is Case No. 0:16-cv-3931, in the U.S. District Court for the District of Minnesota.
