T-Mobile prices class action lawsuit overview:ย

  • Who: A group of consumers filed a class action lawsuit against T-Mobile USA Inc.ย
  • Why: Consumers claim that T-Mobile violated its guarantee that certain wireless cell phone service plans had rates that were guaranteed to last for life.ย
  • Where: The T-Mobile class action lawsuit was filed in New Jersey federal court.ย

T-Mobile violated its guarantee that the terms of certain wireless cell phone service plans would last for life, a new class action lawsuit alleges.ย

A group of consumers claim T-Mobile switched their cell phone plans earlier this year to a more expensive plan without their consent, despite guaranteeing the plans would either last for life or as long as a customer wanted to remain with it.ย

โ€œT-Mobile has reneged on its promises to its customers and raised rates for all the plans with rates that were promised to be guaranteed for life,โ€ the T-Mobile class action says.ย

The group of consumers want to represent a nationwide class and subclasses of consumers in Georgia, Nevada, Pennsylvania and New Jersey who entered into a T-Mobile ONE Plan, Simple-Choice plan, Magenta, Magenta Max, Magenta 55 +, Magenta Amplified or Magenta Military Plan with T-Mobile that included a promise of a lifetime price guarantee and who had their price increased without their consent.ย

T-Mobile promised rates for T-Mobile ONE plans to never change, class action claims

The consumers argue T-Mobile introduced the T-Mobile ONE wireless cell phone service plans โ€” which the company referred to as an โ€œun-contractโ€ โ€” in 2017, at which time the carrier allegedly promised the plansโ€™ rates would never be changed.ย

In 2020, however, T-Mobile completed a merger with Sprint, at which time the former pledged not to raise rates on its phone plans for three years, according to the T-Mobile class action.ย

โ€œNow that the three years have elapsed and the wireless network landscape has continued to contract leaving consumers with less choices,โ€ the T-Mobile class action says.ย

Consumers argue T-Mobile is guilty of common law fraud and common law false advertising and negligent misrepresentation, and of violating New Jerseyโ€™s Consumer Fraud Act, the Georgia Uniform Deceptive Trade Practices Act, the Nevada Deceptive Trade Practices Act and the Pennsylvania Unfair Trade PRactices and Consumer Protection Law.

The plaintiffs demand a jury trial and request injunctive relief and an award of actual damages for themselves and all class members.ย

Mediation for a class action lawsuit revolving T-Mobileโ€™s merger with Sprint failed earlier this year. The complaint argues T-Mobile forced mostly minority-owned stores to close in the wake of the merger, despite telling Congress and the public it would be opening hundreds of stores.ย

The plaintiffs are represented by Bruce H. Nagel and Randee M. Matloff of Nagel Rice, LLP.ย

The T-Mobile prices class action lawsuit is Oddo, et al. v. T-Mobile USA Inc., Case No. 2:24-cv-07719, in the U.S. District Court for the District of New Jersey.

  3. Fololiena Miller says:

I have been a loyal T Mobile customer since 2000 T Mobile Voice Stream.
I have been in contact with Customer Service too many times to count! There were always bogus charges included that they explained away with non sense.
Engaging in a payment plan for all the unexplained extra charges only made it worst!
I even went with PrePaid for 2 years because I was just overwhelmed with their hypocrisy and false advertisements!
2017 ONE plan with 2 lines They kept adding extra fees and increasing the price with excuses! I once made a payment plan to pay $400 unexplained charges, and once it was paid off, they continued to double charge me, telling me it was penalties for the payment plan.

Please add me. I joined T-Mobile April of 2004. That is over TWENTY YEARS AGO and was told my price would Never go up and it has. I wrote a letter to their headquarters and also spoke to two different people from T-Mobile and they told me prices are going up everywhere and they have not raised their prices in 10 years. My prices have not been raised since 2004 so that she prove I was locked into a certain price.

I have a continuous rate increase in my bill. Almost 4oo monthly now and I no devices being paid for. No clear explanation.

    Add me! Magenta plan

  8. Alicia Lopez says:

T-Mobile mobile and WiFi charge $200 per month

  9. Jason says:

I am from Colorado as well and signed up for a business wireless account under these same falsifications.

  10. Timothy Roundy says:

    To Whom It May Concern:
My name is Timothy Roundy, with RNS.
This is regarding my T-Mobile one plan Military Business Account
We purchased this account plan On May 25, 2018 at the T-Mobile store in Aurora Colorado.
    The Plan included:
Up to 12 Voice lines with unlimited talk text and data.
$25 per line with a $5 discount for the first 8 lines / taxes and fees included.
When we purchased this plan my business partner and I saw an advertisement that T-Mobile published where T-Mobile would offer a plan rate that would never go up. After seeing that advertisement my business partner and I visited the T-Mobile store in Aurora Colorado and after seeing signage in the store, and the T-Mobile representative confirming that this was a plan that the price would never go up, we made the change from AT&T to T-Mobile.
Unfortunately T-Mobile raised our rate $5 per line last month which is an increase of $60 per month. Out of frustration I called customer support and after several calls they referred me to you for support on this matter.
I have copies of the advertisement that we saw, as well as my business partner and I corroborating on the signage and T-Mobile representative confirming the price never changing, and I also have a recent call recording of myself and a T-Mobile support representative confirming that the price will not change, and then it did.
I am a retired military veteran that started a business to support and provide under privileged children meals on a weekly basis as well as providing pro bono services including computer networking, video surveillance and cyber security services for small to medium size non-profit organizations, and these increases will affect us in a very negative way.
Please help support us in getting T-Mobile to honor their original agreement and restoring our original pricing.
