T-Mobile prices class action lawsuit overview:ย 

  • Who: A group of consumers filed a class action lawsuit against T-Mobile USA Inc.ย 
  • Why: Consumers claim that T-Mobile violated its guarantee that certain wireless cell phone service plans had rates that were guaranteed to last for life.ย 
  • Where: The T-Mobile class action lawsuit was filed in New Jersey federal court.ย 

T-Mobile violated its guarantee that the terms of certain wireless cell phone service plans would last for life, a new class action lawsuit alleges.ย 

A group of consumers claim T-Mobile switched their cell phone plans earlier this year to a more expensive plan without their consent, despite guaranteeing the plans would either last for life or as long as a customer wanted to remain with it.ย 

โ€œT-Mobile has reneged on its promises to its customers and raised rates for all the plans with rates that were promised to be guaranteed for life,โ€ the T-Mobile class action says.ย 

The group of consumers want to represent a nationwide class and subclasses of consumers in Georgia, Nevada, Pennsylvania and New Jersey who entered into a T-Mobile ONE Plan, Simple-Choice plan, Magenta, Magenta Max, Magenta 55 +, Magenta Amplified or Magenta Military Plan with T-Mobile that included a promise of a lifetime price guarantee and who had their price increased without their consent.ย 

T-Mobile promised rates for T-Mobile ONE plans to never change, class action claims

The consumers argue T-Mobile introduced the T-Mobile ONE wireless cell phone service plans โ€” which the company referred to as an โ€œun-contractโ€ โ€” in 2017, at which time the carrier allegedly promised the plansโ€™ rates would never be changed.ย 

In 2020, however, T-Mobile completed a merger with Sprint, at which time the former pledged not to raise rates on its phone plans for three years, according to the T-Mobile class action.ย 

โ€œNow that the three years have elapsed and the wireless network landscape has continued to contract leaving consumers with less choices,โ€ the T-Mobile class action says.ย 

Consumers argue T-Mobile is guilty of common law fraud and common law false advertising and negligent misrepresentation, and of violating New Jerseyโ€™s Consumer Fraud Act, the Georgia Uniform Deceptive Trade Practices Act, the Nevada Deceptive Trade Practices Act and the Pennsylvania Unfair Trade PRactices and Consumer Protection Law.

The plaintiffs demand a jury trial and request injunctive relief and an award of actual damages for themselves and all class members.ย 

Mediation for a class action lawsuit revolving T-Mobileโ€™s merger with Sprint failed earlier this year. The complaint argues T-Mobile forced mostly minority-owned stores to close in the wake of the merger, despite telling Congress and the public it would be opening hundreds of stores.ย

    They pulled the same thing with me and the Military plan. I have link to their own news release where the CEO promised no changes unles you want to, and there is no caveat to it on the release. I filed an FCC complaint but it does not seem like it is going anywhere.

    I filed a complaint with the FCC against T-Mobile when they pulled a Bait and Switch against me and my family. On January 24, 2024 four of us went to our local T-Mobile store in Lake Stevens, WA. I brought 7 lines to them after they promised free new phones, and a pay off of up to $800 per line for old phones. 4 of us had phones that were paid off so they got their phones within a day or a week or so later. The other 3 phones, which had a total of of $1400 to be paid (they promised to pay off $800 for each) had to wait for 3 months to get their new phones. Meanwhile, a couple of weeks later, Verizon, my old carrier, tried to take the $1400 payoff for the 3 phones out of my debit card. Neither T-Mobile (who promised to pay the balances off) nor Verizon warned us this would happen. I notified them (after my bank warned me they were trying this) that when they sent me an invoice for the pay-off amount, I would pay them. So the phones were paid for. T-Mobile paid me $1000 through a very complicated plan involving credit cards and deposits to my checking account. Then, after 3 months when we went to get our new phones, they made me pay $2600 for them (instead of free as promised). Stupidly, I paid it as my husband was sick with cancer and was so excited about getting the Samsung with the great new camera. Then they wanted another $1200 from my granddaughter for her new phone which I did not pay. That was when I took her off my plan, and filed a complaint with the FCC. It is Bait and Switch. Fortunately I have 2 witnesses who were with me when we negotiated with Sarah their representative and have, in her writing, what they promised the monthly bill would be, and how much they would pay for the old phones and that they would give us new phones free. The third witness, my husband , died in the middle of all this and the anxiety, stress and loss of funds that he needed to pay for his chemotherapy was a huge factor in my decision to try to keep this totally dishonest company from duping other customers to switch to their company with these Bait and Switch tactics.

    I have pictures of a conversation I had with their customer service on May 21st 2024 stating they would never change my plan and would not be doing so in the future. Then may 22nd, they literally sent notice they were increasing my plans price. I had what was a no rate increase military business plan with 9 lines.

    Been on the 55+ plane forever and was promised price lock at $30 a line. Now they raised it $5 each line. With the huge costs of the phones themselves the extra $15 a month for service it too much. If possible to be added to lawsuit would like more information.
