T-Mobile prices class action lawsuit overview:ย

  • Who: A group of consumers filed a class action lawsuit against T-Mobile USA Inc.ย
  • Why: Consumers claim that T-Mobile violated its guarantee that certain wireless cell phone service plans had rates that were guaranteed to last for life.ย
  • Where: The T-Mobile class action lawsuit was filed in New Jersey federal court.ย

T-Mobile violated its guarantee that the terms of certain wireless cell phone service plans would last for life, a new class action lawsuit alleges.ย

A group of consumers claim T-Mobile switched their cell phone plans earlier this year to a more expensive plan without their consent, despite guaranteeing the plans would either last for life or as long as a customer wanted to remain with it.ย

โ€œT-Mobile has reneged on its promises to its customers and raised rates for all the plans with rates that were promised to be guaranteed for life,โ€ the T-Mobile class action says.ย

The group of consumers want to represent a nationwide class and subclasses of consumers in Georgia, Nevada, Pennsylvania and New Jersey who entered into a T-Mobile ONE Plan, Simple-Choice plan, Magenta, Magenta Max, Magenta 55 +, Magenta Amplified or Magenta Military Plan with T-Mobile that included a promise of a lifetime price guarantee and who had their price increased without their consent.ย

T-Mobile promised rates for T-Mobile ONE plans to never change, class action claims

The consumers argue T-Mobile introduced the T-Mobile ONE wireless cell phone service plans โ€” which the company referred to as an โ€œun-contractโ€ โ€” in 2017, at which time the carrier allegedly promised the plansโ€™ rates would never be changed.ย

In 2020, however, T-Mobile completed a merger with Sprint, at which time the former pledged not to raise rates on its phone plans for three years, according to the T-Mobile class action.ย

โ€œNow that the three years have elapsed and the wireless network landscape has continued to contract leaving consumers with less choices,โ€ the T-Mobile class action says.ย

Consumers argue T-Mobile is guilty of common law fraud and common law false advertising and negligent misrepresentation, and of violating New Jerseyโ€™s Consumer Fraud Act, the Georgia Uniform Deceptive Trade Practices Act, the Nevada Deceptive Trade Practices Act and the Pennsylvania Unfair Trade PRactices and Consumer Protection Law.

The plaintiffs demand a jury trial and request injunctive relief and an award of actual damages for themselves and all class members.ย

Mediation for a class action lawsuit revolving T-Mobileโ€™s merger with Sprint failed earlier this year. The complaint argues T-Mobile forced mostly minority-owned stores to close in the wake of the merger, despite telling Congress and the public it would be opening hundreds of stores.ย

The plaintiffs are represented by Bruce H. Nagel and Randee M. Matloff of Nagel Rice, LLP.ย

The T-Mobile prices class action lawsuit is Oddo, et al. v. T-Mobile USA Inc., Case No. 2:24-cv-07719, in the U.S. District Court for the District of New Jersey.

Iโ€™d like to be a part of T-Mobile prices class action lawsuit, as T-mobile increased my phone bill $5/line (4 lines) = $20. Iโ€™ve put in a complaint to the FCC already. A promise / guarantee is their contract to customers, and they broke it.

I needed a new phone and was getting a new one free if I stayed with them 2 yrs. Before buying it I called to make sure that my rate was locked in as I didnโ€™t want to be stuck.woth tjem.2 years if it wasnโ€™t. I was told it was . Then told the same in the store , plus I made them call to be certain and the sales person said the told them.it was Locked in. I had the senior plan 2 unlimited lines for $60. mo. Test, call, data and hot spot included. And I had a watch line $10. mo. A couple weeks later they raised the price. So I told them to cancel the watch line which I didnโ€™t like doing as Iโ€™m 71 and live alone so Iโ€™d bought the watch for safety. Iโ€™ve been with them for over 20 years but looking elsewhere now.id like.to be.part of the class action suit.
