T-Mobile prices class action lawsuit overview:ย

  • Who: A group of consumers filed a class action lawsuit against T-Mobile USA Inc.ย
  • Why: Consumers claim that T-Mobile violated its guarantee that certain wireless cell phone service plans had rates that were guaranteed to last for life.ย
  • Where: The T-Mobile class action lawsuit was filed in New Jersey federal court.ย

T-Mobile violated its guarantee that the terms of certain wireless cell phone service plans would last for life, a new class action lawsuit alleges.ย

A group of consumers claim T-Mobile switched their cell phone plans earlier this year to a more expensive plan without their consent, despite guaranteeing the plans would either last for life or as long as a customer wanted to remain with it.ย

โ€œT-Mobile has reneged on its promises to its customers and raised rates for all the plans with rates that were promised to be guaranteed for life,โ€ the T-Mobile class action says.ย

The group of consumers want to represent a nationwide class and subclasses of consumers in Georgia, Nevada, Pennsylvania and New Jersey who entered into a T-Mobile ONE Plan, Simple-Choice plan, Magenta, Magenta Max, Magenta 55 +, Magenta Amplified or Magenta Military Plan with T-Mobile that included a promise of a lifetime price guarantee and who had their price increased without their consent.ย

T-Mobile promised rates for T-Mobile ONE plans to never change, class action claims

The consumers argue T-Mobile introduced the T-Mobile ONE wireless cell phone service plans โ€” which the company referred to as an โ€œun-contractโ€ โ€” in 2017, at which time the carrier allegedly promised the plansโ€™ rates would never be changed.ย

In 2020, however, T-Mobile completed a merger with Sprint, at which time the former pledged not to raise rates on its phone plans for three years, according to the T-Mobile class action.ย

โ€œNow that the three years have elapsed and the wireless network landscape has continued to contract leaving consumers with less choices,โ€ the T-Mobile class action says.ย

Consumers argue T-Mobile is guilty of common law fraud and common law false advertising and negligent misrepresentation, and of violating New Jerseyโ€™s Consumer Fraud Act, the Georgia Uniform Deceptive Trade Practices Act, the Nevada Deceptive Trade Practices Act and the Pennsylvania Unfair Trade PRactices and Consumer Protection Law.

The plaintiffs demand a jury trial and request injunctive relief and an award of actual damages for themselves and all class members.ย

Mediation for a class action lawsuit revolving T-Mobileโ€™s merger with Sprint failed earlier this year. The complaint argues T-Mobile forced mostly minority-owned stores to close in the wake of the merger, despite telling Congress and the public it would be opening hundreds of stores.ย

The plaintiffs are represented by Bruce H. Nagel and Randee M. Matloff of Nagel Rice, LLP.ย

The T-Mobile prices class action lawsuit is Oddo, et al. v. T-Mobile USA Inc., Case No. 2:24-cv-07719, in the U.S. District Court for the District of New Jersey.

We have Magenta Military and we have been getting gradual increases on our plans via text. When we follow up we get the run around. We have seen a shift of about $30 per month tacked on.

  8. T Ingram says:

I was so furious to find out that my plane was increased $20.00 higher than what I agreed to prior to purchasing my buy one phone get one free plan. I called T mobile about it, and they said that was the plan I agreed to. There was no way of changing it or helping me with my complaint.
I have spent double the amount to this company. I feel like I have been robbed by this company.

  9. Ms. Lambert says:

Good morning, my bill went up by $50 since May. I didnโ€™t put two and two together till I saw this article. Now I saw when it was said the account would go up and I called and talk to someone that said my account would not be affected because of the plan I was on and because I called in saying I donโ€™t want my plan to change. I have recordings off those conversations. So along with that my plan was messed up by a rep about 6 yrs ago and because of that it wouldโ€™ve meant Iโ€™d have to pay for my phones up front full price because the rep removed my service from the lines and from the account and wasnโ€™t able to add me back on because it was a grandfather plan. So I reached out to corporate which had a team member call me by the name of Jessica donโ€™t remember the last name and she paid off one of the phones complete balance which was a little over $300 and then put me on a plan called One plan 55 to make up for it and get me to the closet plan I was on and this one did because it provided a discount if you are 55+ even though I was not. My plan has been that way for 6 yrs no issues and then I noticed this month July that my plan said One Plan not One Plan 55 and that it had been switched back in May but I didnโ€™t notice that slight difference in the plan name which was the 55 wasnโ€™t on there till now. I called and got a hold of corporate again telling them I have been paying $50 extra since May and my plan was changed. Told them why I was on this plan because of their reps mess up and who put me on the plan. Over the years if I had issues Iโ€™d tell whoever Iโ€™m talking to the story and they said ok and that was it no issues they left me on the plan. but this time after talking to corporate Iโ€™m told we canโ€™t move you back because you arenโ€™t 55 and the system wonโ€™t automatically keep me on the plan. He tried to put me on another plan he said was $50 less BUT thatโ€™s not including taxes so at the end of the day after taxes I could still end up right back at $130-$150 just for the plan not including insurance and monthly phone cost etc. so he said heโ€™d put me on the plan and call me back in mid August to see what it comes out to be. Then I see this article and it clicks. This change they did was in May and thatโ€™s when everything happened to my account. It was switched and bill went up. My plan should be honored because they screwed up my account and the grandfather plan I was on I wouldโ€™ve never left had it not been for them. But I think them wanting to raise prices they needed to get me off my plan and doing so switched my plan and raised it. Iโ€™d love to be contact by a lawyer to see what can be done.

  10. James says:

They raised my bill after they told me my bill would never go up as long as my account was in good standing.

    1. Sandra J Petrie says:

They raised my bill $5 per phone. Been with T-Mobile since 2001
