T-Mobile prices class action lawsuit overview:ย 

  • Who: A group of consumers filed a class action lawsuit against T-Mobile USA Inc.ย

T-Mobile violated its guarantee that the terms of certain wireless cell phone service plans would last for life, a new class action lawsuit alleges.ย 

A group of consumers claim T-Mobile switched their cell phone plans earlier this year to a more expensive plan without their consent, despite guaranteeing the plans would either last for life or as long as a customer wanted to remain with it.ย 

โ€œT-Mobile has reneged on its promises to its customers and raised rates for all the plans with rates that were promised to be guaranteed for life,โ€ the T-Mobile class action says.ย 

The group of consumers want to represent a nationwide class and subclasses of consumers in Georgia, Nevada, Pennsylvania and New Jersey who entered into a T-Mobile ONE Plan, Simple-Choice plan, Magenta, Magenta Max, Magenta 55 +, Magenta Amplified or Magenta Military Plan with T-Mobile that included a promise of a lifetime price guarantee and who had their price increased without their consent.ย 

T-Mobile promised rates for T-Mobile ONE plans to never change, class action claims

The consumers argue T-Mobile introduced the T-Mobile ONE wireless cell phone service plans โ€” which the company referred to as an โ€œun-contractโ€ โ€” in 2017, at which time the carrier allegedly promised the plansโ€™ rates would never be changed.ย 

In 2020, however, T-Mobile completed a merger with Sprint, at which time the former pledged not to raise rates on its phone plans for three years, according to the T-Mobile class action.ย 

โ€œNow that the three years have elapsed and the wireless network landscape has continued to contract leaving consumers with less choices,โ€ the T-Mobile class action says.ย 

Consumers argue T-Mobile is guilty of common law fraud and common law false advertising and negligent misrepresentation, and of violating New Jerseyโ€™s Consumer Fraud Act, the Georgia Uniform Deceptive Trade Practices Act, the Nevada Deceptive Trade Practices Act and the Pennsylvania Unfair Trade PRactices and Consumer Protection Law.

The plaintiffs demand a jury trial and request injunctive relief and an award of actual damages for themselves and all class members.ย 

Mediation for a class action lawsuit revolving T-Mobileโ€™s merger with Sprint failed earlier this year. The complaint argues T-Mobile forced mostly minority-owned stores to close in the wake of the merger, despite telling Congress and the public it would be opening hundreds of stores.ย

    Iโ€™m currently a customer of TMO. My rate plan went up a few dollars. Weโ€™d been on Mag Max, then switched to one of their newer plans. I was on the phone a couple of times with various agents over a few days and one of the agents who honestly was wonderful but Pissed me off because we were the step down from the top plan And without asking, she put me back on the top plan. Then I had to call and get that switched but because all of these calls happen within a few days of each other, I got stuck on the top plan for a month before they would fix it back to the step down from the top plan. Which meant I paid more than I should have for a choice I didnโ€™t make. That did really upset me. Iโ€™m located in Connecticut. Please speak to Sen. Richard Blumenthal about including Connecticut in this class action lawsuit.

    I was told that for 2 lines, that my bill would be 195.00 and I would receive 2 phones for free but once after I kept wondering why my bill wasnโ€™t what they say it was going to be and it was a different number each month, I had called and spoke to 2 different agents about it requesting a paper statement I reviewed it and I be darn my phones wasnโ€™t free and I have been paying over the amount for my 2 lines. For months I have been overcharged and was promised to be fixed. Never was fixed. Lost out on money.

    Our bill went up $45 a month. Even though we were grandfathered and locked into our Magenta Military rate plan. Weโ€™d leave, but they brilliantly came up with a scheme to get customers โ€œlocked inโ€ with them. They had a bunch of phone promos available last November and December. We signed up and now have 24 months of EIPโ€™s. We have to stay with them or lose even more money. Totally tied our hands. Everything theyโ€™ve done is outrageous and bad business

      If another carrier has a deal thatโ€™ll pay off your remaining balance on the phones, and you can get a better rate, do it.

    I was with Sprint for over 25 years.
    Shortly after the merger, I was contacted by T-Mobile informing me that my $40/month plan wouldnโ€™t change.
    Well, to my surprise my phone plan was changed and raised to $83/month.

    My plan went up $15 a month out of no where. I never agreed to pay more. I have auto payments so they just decided to help themselves with my money.

    I was told my rates were locked and for life as Long as I stayed with t-mobile. They turned around and stiffed us.

    My bill increased in Florida and I was told the price was locked in due its competitors pricing.
