T-Mobile prices class action lawsuit overview:ย

  • Who: A group of consumers filed a class action lawsuit against T-Mobile USA Inc.ย
  • Why: Consumers claim that T-Mobile violated its guarantee that certain wireless cell phone service plans had rates that were guaranteed to last for life.ย
  • Where: The T-Mobile class action lawsuit was filed in New Jersey federal court.ย

T-Mobile violated its guarantee that the terms of certain wireless cell phone service plans would last for life, a new class action lawsuit alleges.ย

A group of consumers claim T-Mobile switched their cell phone plans earlier this year to a more expensive plan without their consent, despite guaranteeing the plans would either last for life or as long as a customer wanted to remain with it.ย

โ€œT-Mobile has reneged on its promises to its customers and raised rates for all the plans with rates that were promised to be guaranteed for life,โ€ the T-Mobile class action says.ย

The group of consumers want to represent a nationwide class and subclasses of consumers in Georgia, Nevada, Pennsylvania and New Jersey who entered into a T-Mobile ONE Plan, Simple-Choice plan, Magenta, Magenta Max, Magenta 55 +, Magenta Amplified or Magenta Military Plan with T-Mobile that included a promise of a lifetime price guarantee and who had their price increased without their consent.ย

T-Mobile promised rates for T-Mobile ONE plans to never change, class action claims

The consumers argue T-Mobile introduced the T-Mobile ONE wireless cell phone service plans โ€” which the company referred to as an โ€œun-contractโ€ โ€” in 2017, at which time the carrier allegedly promised the plansโ€™ rates would never be changed.ย

In 2020, however, T-Mobile completed a merger with Sprint, at which time the former pledged not to raise rates on its phone plans for three years, according to the T-Mobile class action.ย

โ€œNow that the three years have elapsed and the wireless network landscape has continued to contract leaving consumers with less choices,โ€ the T-Mobile class action says.ย

Consumers argue T-Mobile is guilty of common law fraud and common law false advertising and negligent misrepresentation, and of violating New Jerseyโ€™s Consumer Fraud Act, the Georgia Uniform Deceptive Trade Practices Act, the Nevada Deceptive Trade Practices Act and the Pennsylvania Unfair Trade PRactices and Consumer Protection Law.

The plaintiffs demand a jury trial and request injunctive relief and an award of actual damages for themselves and all class members.ย

Mediation for a class action lawsuit revolving T-Mobileโ€™s merger with Sprint failed earlier this year. The complaint argues T-Mobile forced mostly minority-owned stores to close in the wake of the merger, despite telling Congress and the public it would be opening hundreds of stores.ย

The plaintiffs are represented by Bruce H. Nagel and Randee M. Matloff of Nagel Rice, LLP.ย

The T-Mobile prices class action lawsuit is Oddo, et al. v. T-Mobile USA Inc., Case No. 2:24-cv-07719, in the U.S. District Court for the District of New Jersey.

  1. Jen B says:

Weโ€™ve been with T mobile since 2005. We are in the Magenta 55+ plan and received a text stated our price would increase by $5 per line. Not happy about this. We were told it would never increase. Tough for us being on fixed income

  2. Shelia Winsley says:

I have also seen an increase in my bill. And if Iโ€™m not mistaken, Iโ€™m supposedly on the Magenta plan thatโ€™s supposed to save me money? I just got caught up from that โ€œarrangement planโ€ but my bill remains higher than when I purchased the phone last year.

  3. Stephanie Dudley says:

I have been T-MOBILE for over 8 years and they have raised my rates various times and itโ€™s not getting any better. Iโ€™m a senior citizen on a fixed income and struggling to pay this bill every month.

    1. Jason B says:

T-Mobile became a fraudulent company once the new CEO took over. Cell phone plans of 3 lines or less should never cost almost $300. I would like to see the โ€œhidden feesโ€ they say that their is none. Always a lie

  4. Michelle says:

Include customers from NY as they raised the rates here too!

  5. Dustin says:

Yes T-Mobile raised my plan. I have been with them for 15yrs plus and I had plan that not supposed to change but sadly they did and caused my price to raised.

  6. Debra anderson says:

T-Mobile did the same thing to me also allowed somewlse not on my plan to have access to my account and give my grandsons phone digits without telling me then told me it wasnโ€™t costing me any money. Thatโ€™s not the point when I had custody of him and could not reach him on a school trip that was clear across the state and that was not ok.

  7. Ronilee Ellis says:

    Yes, it did go up!

  8. Marcela says:

Have been with T-Mobile for over 15 years and my plan was supposed to be grandfathered in and now by bill is $30 higher

  9. Tim Godfriaux says:

My bill has been raised as well.

    1. Maria Ventrella says:

      Yes

      1. Aaron L Spilker says:

11 Lines on our plan. Rate went up $55 a month. $660 a year is a helluva increase for frigging air time. Weโ€™ve loved T Mobile but hope they get what is coming to them. They lied. Thatโ€™s not acceptable.

  10. Patti says:

Was suppose be grandfathered into my plan they raised my bill and said that everyone that was grandfathered in would have a higher bill by $10 per month. I live in Georgia and my bill was never suppose to change.

    1. Kimbo Jonas says:

I live in Utah. Had a galaxy note 4 at the beginning of 2023. In Feb the service just stopped. They told me they no longer supported my phone. Said come get free phones on us. They took my grandfathered plan with my sim cards for two lines & forced me to get a higher priced plan. The old sims would have went right in the new phones. Made me pay over $250 in new connection fees & doubled my bill. I have been living from payment arrangement to payment arrangement for 18 months now. Cant catch up. That is only icing on cake compared to the other illegal things tmobile has done & forced me to do. All of it costing thousands.
