T-Mobile prices class action lawsuit overview:ย 

  • Who: A group of consumers filed a class action lawsuit against T-Mobile USA Inc.ย

T-Mobile violated its guarantee that the terms of certain wireless cell phone service plans would last for life, a new class action lawsuit alleges.ย 

A group of consumers claim T-Mobile switched their cell phone plans earlier this year to a more expensive plan without their consent, despite guaranteeing the plans would either last for life or as long as a customer wanted to remain with it.ย 

โ€œT-Mobile has reneged on its promises to its customers and raised rates for all the plans with rates that were promised to be guaranteed for life,โ€ the T-Mobile class action says.ย 

The group of consumers want to represent a nationwide class and subclasses of consumers in Georgia, Nevada, Pennsylvania and New Jersey who entered into a T-Mobile ONE Plan, Simple-Choice plan, Magenta, Magenta Max, Magenta 55 +, Magenta Amplified or Magenta Military Plan with T-Mobile that included a promise of a lifetime price guarantee and who had their price increased without their consent.ย 

T-Mobile promised rates for T-Mobile ONE plans to never change, class action claims

The consumers argue T-Mobile introduced the T-Mobile ONE wireless cell phone service plans โ€” which the company referred to as an โ€œun-contractโ€ โ€” in 2017, at which time the carrier allegedly promised the plansโ€™ rates would never be changed.ย 

In 2020, however, T-Mobile completed a merger with Sprint, at which time the former pledged not to raise rates on its phone plans for three years, according to the T-Mobile class action.ย 

โ€œNow that the three years have elapsed and the wireless network landscape has continued to contract leaving consumers with less choices,โ€ the T-Mobile class action says.ย 

Consumers argue T-Mobile is guilty of common law fraud and common law false advertising and negligent misrepresentation, and of violating New Jerseyโ€™s Consumer Fraud Act, the Georgia Uniform Deceptive Trade Practices Act, the Nevada Deceptive Trade Practices Act and the Pennsylvania Unfair Trade PRactices and Consumer Protection Law.

The plaintiffs demand a jury trial and request injunctive relief and an award of actual damages for themselves and all class members.ย 

Mediation for a class action lawsuit revolving T-Mobileโ€™s merger with Sprint failed earlier this year. The complaint argues T-Mobile forced mostly minority-owned stores to close in the wake of the merger, despite telling Congress and the public it would be opening hundreds of stores.ย

    I am currently subscribed to the Magenta plan with three lines. I live in New York, and I recall their promise never to increase the cost of the plan. It is encouraging to see people taking action against T-Mobile. I would like to inquire if it is possible for me to join this lawsuit.

    I am on the military plan. We had 6 phones go up $5 each and 2 watches go upm$2 each. Also they promise AAA. That โ€œexpiredโ€.

    Iโ€™m on the 55+ plan and they raised my bill $5 when told me my bill will never go up from $50

      They almost doubled my rate after 6 months. Plus they said I was not under a contract, but when I tried to switch to a less expensive company, I was told that my phone was locked for a total of 3 years and I was unable to switch carriers. When I said that I shouldnโ€™t be under a contract, they told me that I wasnโ€™t and that I could leave at any time, just not with my phone.

        They are sneaky like that. They say the phone is โ€œOn Usโ€, which in any other usage of the phrase โ€œOn Usโ€ or โ€œOn meโ€ if means the party stating it is paying for whatever is โ€œOn themโ€. But with T-Mobile they only actually pay the cost of the phone monthly and if you leave bf the amount Iโ€™d months they must pass fur the phone to be paid in full, they hit you with the remaining cost all at onceโ€ฆ Super shadyโ€ฆ

    Yes, T-Mobile is the worst. They changed my plan without my consent. They also promised if I switched my carrier port in my number and buy a phone with a new lne I would get $200 a line on a prepaid card. Almost 2 years later I didnโ€™t get them. Everytime I contact then they say I have to wait for approval. Absolutely ridiculous.

    Our plan went up by $15. Weโ€™ve been on the military magenta since we signed up in 2019. If you publicly advertise and promise not to increase your plan and thatโ€™s what sets you apart from other providers, then stick to your word.

    I also have the Magenta Military Plan with T-Mobile. It was suppose to be 25.00 per line for life or until we cancelled. Well Iโ€™m still alive and we have not switched carriers. So guess everyone lies. They should be required to honor their agreements.

      I have the magenta 55 plus plan. It increased $5, but they deducted that if I signed up for auto pay with my checking account. So I was forced to do that. Wasnโ€™t happy about it. I prefer to pay with my credit card. That being said, the service is good. I just wish these companies would keep their promises rather breaking them and creating the hassle of litigation. I hope theyโ€™re required to stand by their promise for those of us who trusted them and signed up expecting them to keep that promise.

      T-Mobile raised my price after promising not to ever raise my price. I was a relatively new customer to T- Mobile., couple of months.

      Iโ€™m on magenta have been for years now, the promise of no price change as long as I choose to keep it had no end time, not in the fine print or anything else. Literally price for life, until now. Itโ€™s a blatant contract violation and in Iowa a โ€œhandshakeโ€ agreement is a legally binding contract. I started out at $70 Iโ€™m at over $80 for just the magenta plus an include for โ€œfreeโ€ second and another $20 for a third. Add in the internet even after removing all the โ€œinsuranceโ€ and Iโ€™m still paying $200. I donโ€™t switch because Verizon is the same and well US Cellular isnโ€™t a choice anymore.
