T-Mobile violated its guarantee that the terms of certain wireless cell phone service plans would last for life, a new class action lawsuit alleges.ย
A group of consumers claim T-Mobile switched their cell phone plans earlier this year to a more expensive plan without their consent, despite guaranteeing the plans would either last for life or as long as a customer wanted to remain with it.ย
โT-Mobile has reneged on its promises to its customers and raised rates for all the plans with rates that were promised to be guaranteed for life,โ the T-Mobile class action says.ย
The group of consumers want to represent a nationwide class and subclasses of consumers in Georgia, Nevada, Pennsylvania and New Jersey who entered into a T-Mobile ONE Plan, Simple-Choice plan, Magenta, Magenta Max, Magenta 55 +, Magenta Amplified or Magenta Military Plan with T-Mobile that included a promise of a lifetime price guarantee and who had their price increased without their consent.ย
T-Mobile promised rates for T-Mobile ONE plans to never change, class action claims
The consumers argue T-Mobile introduced the T-Mobile ONE wireless cell phone service plans โ which the company referred to as an โun-contractโ โ in 2017, at which time the carrier allegedly promised the plansโ rates would never be changed.ย
In 2020, however, T-Mobile completed a merger with Sprint, at which time the former pledged not to raise rates on its phone plans for three years, according to the T-Mobile class action.ย
โNow that the three years have elapsed and the wireless network landscape has continued to contract leaving consumers with less choices,โ the T-Mobile class action says.ย
Consumers argue T-Mobile is guilty of common law fraud and common law false advertising and negligent misrepresentation, and of violating New Jerseyโs Consumer Fraud Act, the Georgia Uniform Deceptive Trade Practices Act, the Nevada Deceptive Trade Practices Act and the Pennsylvania Unfair Trade PRactices and Consumer Protection Law.
The plaintiffs demand a jury trial and request injunctive relief and an award of actual damages for themselves and all class members.ย
Mediation for a class action lawsuit revolving T-Mobileโs merger with Sprint failed earlier this year. The complaint argues T-Mobile forced mostly minority-owned stores to close in the wake of the merger, despite telling Congress and the public it would be opening hundreds of stores.ย

Ever since they got the other phone companies with them they have been doing so many shady stuff like how do I go from paying 160 to 215 and I donโt even have new phones.

Mine went up. Then again mine has hardly ever been the same. I donโt ever touch it with unlimited magenta max and it constantly changes. It went from $139 to $115 then shot to $233, and my most constant was $163 and then they did the price change and we are steady now at $170.
Since day one my prices have fluctuated. The most irritating was the $233, and if you go to bill break down it doesnโt show you whatโs different it just list it in the same categories as usually just with extra numbers as if thatโs helpful. All that to say I believe itโs wrong to guarantee a no price change ever and then change my price at all.
Changed from Verizon to T-Mobile because of rising prices and nickel and dime extra charges. T-Mobileโs coverage had a lot to be desired but stayed with them hoping that service would get better.
The worst part of the lie for me is that they came out with this idea of an โun-contractโ with a rate set until the customer decides to change it. They came out with this promotion as a direct response to what was going on with Verizon at the time. I was a Verizon customer and had a guaranteed locked in rate that Verizon decided to stop honoring. T-Mobile promoted themselves as the uncarrier and promised rates would not change in a direct attempt to get customers from Verizon, which worked for me and likely millions of others. It is very clear what they were promising back then when you put it all into context. Hopefully the attorneys for this will be able to do just that.
I was lied to about T Mobileโs price lock guarantee. I live in Florida and will gladly join a class action suit.

I have called and complained how I was on the 55+ plan with price lock. They didnโt listen. I am on a trial of Visual powered by Verizon. $25 per month
