T-Mobile violated its guarantee that the terms of certain wireless cell phone service plans would last for life, a new class action lawsuit alleges.
A group of consumers claim the company switched their cell phone plans earlier this year to a more expensive plan without their consent, despite guaranteeing the plans would either last for life or as long as a customer wanted to remain with it.
“T Mobile has reneged on its promises to its customers and raised rates for all the plans with rates that were promised to be guaranteed for life,” the class action says.
The group of consumers want to represent a nationwide class and subclasses of consumers in Georgia, Nevada, Pennsylvania and New Jersey who entered into a T-Mobile ONE Plan, Simple-Choice plan, Magenta, Magenta Max, Magenta 55 +, Magenta Amplified or Magenta Military Plan with the company that included a promise of a lifetime price guarantee and who had their price increased without their consent.
T Mobile promised rates for their ONE plans were to never change, class action claims
The consumers argue the company introduced the ONE wireless cell phone service plans — which the company referred to as an “un-contract” — in 2017, at which time the carrier allegedly promised the plans’ rates would never be changed.
In 2020, however, the company completed a merger with Sprint, at which time the former pledged not to raise rates on its phone plans for three years, according to the class action.
“Now that the three years have elapsed and the wireless network landscape has continued to contract leaving consumers with less choices,” the class action says.
Consumers argue T-Mobile is guilty of common law fraud and common law false advertising and negligent misrepresentation, and of violating New Jersey’s Consumer Fraud Act, the Georgia Uniform Deceptive Trade Practices Act, the Nevada Deceptive Trade Practices Act and the Pennsylvania Unfair Trade PRactices and Consumer Protection Law.
The plaintiffs demand a jury trial and request injunctive relief and an award of actual damages for themselves and all class members.
Mediation for a class action lawsuit revolving T-Mobile’s merger with Sprint failed earlier this year. The complaint argues the company forced mostly minority-owned stores to close in the wake of the merger, despite telling Congress and the public it would be opening hundreds of stores.

When we signed up with them I paid our bill for 13 months in advance. Then they told me we didn’t qualify for quoted price of $30 per line. Then charged us more yet. Our 13 month payment ended up being 11. Just went and paid for second year in advance. We are getting screwed already. It was $774 for each line plus. Will leave as soon as we can. We are 60 years old and don’t qualify for senior rates.
Yep,was with the. For years without any issues. Suddenly every couple of months it’s go up. When we did add s few things we were completely lied to about what charges would be. And then it continued to increase. Id always adored tmobile and then the last 2-3 years I was with them was horrible.
I had a business account and they wrote in an invoice that a would pay a lower amount deal by transferring from AT&T. I was with them for almost a year. Some discounts went though, bit many didn’t and I was lied to. I called the business dept and got the run around and I called the business account manager and he failed to call me back to explain why my credits were not hitting my account. I have emails and proposal invoices all documents. Please add me to this lawsuit!
