A judge in Florida federal court has put her stamp of approval on a $42 million settlement agreement which resolves three lawsuits claiming that General Motors sold vehicles with an oil consumption defect.

Plaintiffs Ellen Berman and Dayana Guach allege that General Motors model year 2010-2013 Chevrolet Equinox and GMC Terrain cars that have 2.4-liter Ecotec engines suffer from the defect that consumes oil at a very high rate.

The primary cause of the defect is malfunctioning piston rings, which are prone to premature wear, the judge’s order states. The defect necessitates the need for the car owner to replenish the car’s oil more frequently.

The plaintiffs filed suit in September 2018, claiming that General Motors breached their written warranties under the Magnuson-Moss Warranty Act and violated the Florida Deceptive and Unfair Trade Practices Act.

Two other class action lawsuits were subsequently filed, based on similar allegations. The judge’s approval of the settlement resolves the claims in these three cases.

Starting in 2014, General Motors issued Special Coverage Adjustments (SCAs) for the model years 2010-2012 of the class vehicles, the judge’s order reads.

The SCAs were put into effect to extend the class vehicles’ warranty for piston replacement beyond the normal warranty expiration period, which was five years or 100,000 miles.  

“The SCAs provided that owners of Class Vehicles could take their vehicles to a dealership and undergo an oil consumption diagnosis. If the diagnosis indicated excessive oil consumption, GM would replace the piston rings for free, if the vehicle was within certain time and mileage limitations,” the judge states in her order.

The Settlement Class is defined as: “All persons within the United States who purchased or leased, at any time before the Preliminary Approval Date, a new retail or used model year 2010, 2011, 2012, or 2013 Chevrolet Equinox or GMC Terrain vehicle equipped with 2.4 liter Ecotec engines, manufactured prior to the Production Change, and who have not executed a prior release of claims related to Class Vehicle oil consumption or resulting piston or engine damage in favor of GM.”

In addition, the judge’s order states that, for model year 2010-2012 class vehicles, owners will be able to get a free replacement of piston assemblies at authorized dealerships.

Also, Class Members who already paid for covered repairs but who did not already submit a claim under the Special Coverage Adjustments will have 120 days to submit a claim.

For model year 2013 class vehicles, Class Members will receive free piston assembly replacement. Also, those who previously paid out-of-pocket for repairs can file claims for reimbursement of expenses.

Each Class representative will receive $4,500 as a service payment, which the judge determined to be “appropriate, fair, and reasonable.” This award is being paid by General Motors separately from the funds being made available via the settlement agreement.

Also, the attorneys for the plaintiffs will receive fees of $3,390,351, which is eight percent of the settlement value. Class Counsel will also receive reimbursement of $109,649 for litigation expenses.

    Finally received a denial letter eventhough we had plenty of evidence we were having consumption issues which led to our timing chain stretch. GM make think they are winning denying most claims but in the end they are losers. We have bought two new cars since neither from GM. Never buying GM again and we are young enough for that to be many more cars.

    I just received denial letter November 13 2020 (Friday) Only have 10 business days to contest denial of claim. All supporting documents was mailed February 2020, it took them all this time to send a denial letter. But, only giving me 10 business days to contest. This is BS!

    I believe I should be included in the lawsuit. I have a 2012 Chev Equinox with 2.4 L engine. The engine blew last year because of lack of oil. Could someone contact me?

      I too believe I should be entitled to something. My 2010 equinox engine blew after only 60,000 miles. I was putting 2 quarts in every 2 weeks . This car is a POS

      I was never contacted about this claim. I’ve had the engine on my 2013 GMC Terrain replaced and then rebuilt and I’m currently having the same issue again. Just learned of this claim and I’m at the dealership as we speak to start the oil consumption test but they told me GM won’t cover the replacement costs bc I’m over 120,000 miles?? It’s a 7 year old car and I see nothing about that stipulation above.

    I have a 2012 Equinox and bought it brand new. I have never had a problem until now. Took it in for an oil change and have it looked at for a strange noise and was told I was 4 quarts low on my oil, had some timing issues and then was told I needed a new engine. I didn’t know anything about this problem at all. Does anyone know if this class action suit covers this or is it too late?

    I own a 2013 Equinox and never notified of this lawsuit or a recall. I have 30,000 miles on my car and understand the piston issue happens around 100,000 miles. Want to get fixed before it happens. Help! The piston assembly needs to be addressed ASAP. Thx for info

    I have a 2010 Chevy equinox with over 150,000 miles and I got it barely a year ago and it’s stopped running due to the pistons. Will Chevy fix this for free? I had to put a qt. of oil in once a week for the whole year. What do I do?

    I owned a Chevy equinox in great condition. out of the blue the oil kept having issues. I would get the oil changed and fill it but it didn’t matter. my engine blew because of this oil issue. I had to let the car go as a repo because I needed to get another car for work and school and I could not afford 2 payments. This ruined my credit, we were not able to get a house. I called my loan and tried to find someone at Chevy to help and I had no one that was willing to help me. Chevy cost me so much more than just a car.

    I own a 2013 Equinox, my engine is consuming oil like crazy. I received a litigation letter in January 2020. I started the process of monitoring my oil consumption, they told me that they could not help me because the time had expired. What should I do? Gm said that they would only cover $238 to fix the piston rings on my engine and I will be responsible for the other approximate $2,700. I don’t think it’s fair! I am so frustrated I just happened to search about the litigation and stumbled upon the website thank you so much for this article!!
