Nissan Transmission Defect Class Action Settlement Overview: 

  • Who: A federal judge certified a $277.7 million class action settlement between Nissan and two subclasses of its vehicle owners. 
  • Why: Drivers allege Nissan sold vehicles with defective transmissions.
  • Where: The class action settlement was approved in Tennessee federal court.

A federal judge has conditionally certified a $277.7 million class action settlement agreement between Nissan and car owners who allege the company sold vehicles with defective transmissions. 

The settlement will be split between a Class of 2014-2018 Nissan Rogue owners and a Class of 2015-2018 Nissan Pathfinders and 2015-2018 Infiniti QX60 vehicle owners. 

“The Parties have made an adequate showing at this stage that the class action settlement set forth in the Settlement Agreement is substantively and procedurally proper,” wrote US District Judge William L. Campbell. 

Nissan Transmission Defect Class Members May Get Vouchers, Reimbursement, More

The $277.7 million Nissan class action settlement will cover a new vehicle warranty extension of 24 months or 24,000 miles — whichever comes first — in addition to repair reimbursements. 

Drivers who had their transmissions repaired at certified dealerships within the extended warranty will be eligible for full reimbursement, while vehicle owners who had repairs completed at unaffiliated repair shops will be reimbursed for up to $5,000. 

Plaintiffs will also receive $1,000 vouchers that can go towards the purchase or lease of a new vehicle. 

The settlement agreement is the result of five class action lawsuits that were consolidated over allegations Nissan sold vehicles with defective continuously variable transmissions (CVTs). 

Plaintiffs alleged in their class action lawsuits that defective CVTs in certain Nissan Rogue, Pathfinder, and Infiniti QX60 vehicles were prone to “unexpected malfunction by hesitating, stalling, jerking, lurching, revving, shaking, juddering and failing prematurely.” 

The preliminarily approved class action settlement will now be subject to a fairness hearing.

    I am the owner of a 2018 Nissan Rogue with approximately 56,000 miles on it. I leased the Rogue in August of 2018 and purchased the car on August 27, 2021 from Sansone Jr.’s 66 Auto mall service located at 3401 New Jersey 66, Tinton Falls, New Jersey 732-922-1050 .
    For the last year, I am experiencing a problem accelerating the car to the highway speed after stop and go traffic. It will not go past thirty miles per hour and will not switch into the next gear. This has happened on at least five occasions. I will be driving at a highway speed of approximately 65 mph and then I must come to a stop due to traffic. When I try to regain the highway speed of 65 mph again, I am unable to do so. I must pull over on the highway and shut the car off. Once I restart the car, I can reach highway speed again. This is extremely dangerous when driving on a highway. There is not always a safe place to pull the car over, so I must put my hazard lights on and slowly navigate to an exit.
    My personal mechanic consulted with his transmission person and was advised that the transmissions used in the 2018 Nissan Rogue model have been defective in some cases.
    I made an appointed with Sansone Jr.’s 66 Automall service located at 3401 New Jersey 66, Tinton Falls, New Jersey 732-922-1050 on August 26, 2024 to inspect the problem with my car. After two days, I was advised by Elizabeth Gisle that the mechanics were unable to recreate the scenario in my car. The mechanic drove it for approximately 40 miles. But she did not know if a traffic jam was encountered when testing the car. The mechanic serviced my car for two recalls in the hope that it would remedy the problem.
    IT DID NOT. Now, it happened again recently when I was driving on a local road in stop and go traffic. I was traveling at approximate speed of 25 miles per hour for approximately 30 minutes in stop and go traffic.
    I reached out to Nissan Consumer Affairs on Tuesday, September 17, 2024 and opened a case # and spoke to Farihat. In addition, I received an email from Kentrese the Consumer Affairs Representative of Nissan North America stating a case # has been created. Kentrese called me on Monday, September 24, 2024 and said there is nothing that can be done. The Nissan Dealership located at Sansone Jr.’s 66 Automall service located at 3401 New Jersey 66, Tinton Falls, New Jersey 732-922-1050 was consulted and was unable to recreate the above driving scenario. I offered to submit sworn affidavits from passengers in my car attesting to the sound of the engine and the inability of the car to excel to the normal speed limit once encountered with stop and go traffic. But the offer was declined.
    I have another service appointment with Sansone Jr.’s 66 Automall service located at 3401 New Jersey 66, Tinton Falls, New Jersey 732-922-1050 on Thursday, October 3, 2024. The mechanics must recreate the problem of the car not excelling to the speed limit once it is caught in stop and go traffic. This is an extremely dangerous position to put a driver in and I am receiving little to no support to rectify this dangerous problem with my car.
    Please acknowledge that you have received this letter and the solution set forth to rectify it.
    I have worked in litigation for most of my career and yes this is a threatening letter. God forbid something were to happen to me or my son who is a new driver, an action will be commenced against Nissan North America, Inc. and Sansone Jr.’s 66 Automall service located at 3401 New Jersey 66, Tinton Falls, New Jersey. Please forward this letter to the in-house Legal Dept. of Nissan North America, Inc. or to your outside counsel for review.

    I have a 2020 Nessan Sentra with 30,000 miles and needs new tie rods. They say it is covered under warranty, however, they cannot obtain any replacement tie rods from Nessan. It will be months or more before they are available. I am driving an unsafe car and they don’t care. It is the only car I have. They have the parts because new cars are coming off their assembly line everyday. They are hording these tie rods. I need help now. What can I do?

    I have a 2013 Nissan Ultima and was just told at the dealership i needed a new transmission. There was a class action suit won but closed last year for this vehicle Do I have any recourse? I only have 86,166 miles and a quote of $6,500.00 in repairs , definitely defective!

    I own a 2013 nissan maxima with the exact same symptoms and transmission issues due to my CVT transmission. The issue isn’t the make and model of the vehicle, its the CVT transmission itself. How am I supposed to come up with (roughly) $5,000 for parts and labor simply because they are selling defective transmissions?

    I have a Nissan Rogue Select and have just discovered that I need to repair/replace my transmission costing over $6,000. Was told that there was a lawsuit regarding Nissan Rogue and was wondering if my repairs would be covered by this lawsuit and how to get help.

    2011 Nissan Sentra only 89000 miles on it need new transmission. Mechanic won’t replace because he can’t warranty any replacement either new or used. Do I have any recourse?
