Mitsubishi Transmission Class Action Lawsuit Overview:

  • Who: Three drivers of Mitsubishi vehicles have filed a class action lawsuit against Mitsubishi.ty
  • Why: The drivers say some of the auto manufacturer’s cars have a dangerously defective continuously variable transmission.
  • Where: The lawsuit was filed in a California federal court.

Mitsubishi Motors produces vehicles equipped with a continuously variable transmission (CVT) that is dangerously defective, making cars shudder, jerk and fail to accelerate, a new class action lawsuit alleges.

Plaintiffs Ryan Hardy, Troy Lucassian and Todd Brown filed the class action lawsuit against Mitsubishi Motors North America and Japanese company Mitsubishi Motors Corp Dec. 3 in a California federal court, alleging violations of federal warrant law and state consumer law.

The drivers are looking to represent anyone in the United States who purchased or leased a 2014-2017 Mitsubishi Lancer, 2014-present Mitsubishi Outlander, 2014-present Mitsubishi Outlander Sport, 2014-present Mitsubishi Mirage or 2018-present Mitsubishi Eclipse Cross.

Plaintiffs Claim The CVTs Often Fail Just Outside The Warranty Period

According to the lawsuit, Mitsubishi sold these cars without disclosing that the CVT was defective.

“Specifically, Plaintiffs are informed and believe, and based thereon allege, that the CVT is defective in that it causes the vehicle to shudder, surge, jerk, to delay acceleration or fail to accelerate, and, ultimately, catastrophic transmission failure,” the class action states.

The plaintiffs say Mitsubishi sold the vehicles with either a 10-year or 5-year warranty that purports to cover the CVT.

“However, owners and lessees often have complained that their CVTs fail and require replacement both within and just outside the warranty period,” according to the lawsuit.

The lawsuit says discovery will show, since 2014 if not earlier, Mitsubishi has been aware the transmissions would need frequent repair or fail.

As a result, the drivers are seeking certification of the class action, damages, fees, costs and a jury trial.

In 2020, drivers of Nissans with CVTs that failed received thousand-dollar checks in the mail after a class action settlement over the issue.

My 2015 Mitsubishis transmission went out a weeks ago they are having to rebuild the transmission right now. I just finished paying it off a week ago and I can’t even use it. I paid a lot of money just to get it inspected and checked by multiple mechanics. I even took it to the dealer and the mechanics there didn’t look at my car they just had the front desk lady say I needed a new transmission. Bc she felt it slipping. My dad asked what was wrong with the transmission and they couldn’t tell us even though they had it for a week. If I could get more information about this to join this I would appreciate it.

I have a 2016 Mitsubishi Lancer Es 2.4 that I purchased used in 2023. In 2024 I was driving and the “Transmission Failure” light came up. I took it to a dealer who quoted me 9,000 dollars to fix it and a wait of over a month because this particular transmission was discontinued. Then I found another mechanic who was able to find a used transmission and 8,000 dollars later, my car is on the road again. Im afraid that this ordeal may happen again, leaving me carless and moneyless.
