Navistar TruckA website has been established to inform Class Members of their rights under a Navistar class action settlement.

A $135 million settlement deal has been reached that will end claims that Navistar knowingly sold vehicles with defective diesel engines. Per the terms of the proposed settlement deal, an $85 million cash fund and a $50 million rebate fund will be created that will compensate Class Members for alleged injury.

The settlement website notes that Class Members include individuals who purchased or leased a 2011-2014 model year Navistar vehicles in the United States or a U.S. territory that had a MaxxForce 11- or 13-liter engine “certified to meet EPA 2010 emissions standards without selective catalytic reduction technology.”

The website notes that no parties have been found guilty of wrongdoing, and the settlement deal was struck to avoid the potential costs and risks of continuing to litigate the engine defect claims.

The settlement website explains that Class Members have a number of options under the settlement agreement. Class Members can opt out of the settlement deal, which must be done by October 10, 2019. If a Class Member chooses to opt out, they will receive no benefits from the Navistar class action settlement, but they retain their rights to pursue independent litigation against the company.

Class Members may object to or comment on the settlement by writing to the Court about the settlement by October 10, 2019.

Class Members who submit a claim form and receive benefits from the Navistar class action settlement must submit a claim form by May 11, 2020. Class Members who receive benefits from the Navistar diesel engine class action settlement do give up their rights to pursue other litigation against the company.

Class Members who do nothing will not receive payment from the settlement fund and will give up their rights to pursue independent litigation against Navistar.

Per the terms of the Navistar class action settlement deal, Class Members may choose one of three compensation options — a cash option, a rebate option, and a repair compensation option. Claim forms are not yet available, but will be soon made available on the Navistar settlement website.

Under the cash benefits option, Class Members are eligible to receive up to $2,500 for each affected vehicle owned or leased. The amount that a Class Member is eligible to receive depends on how long they have owned or leased their vehicle. Class Members will receive their benefits in monthly payments between $26 and $39, depending on the affected vehicle’s model year.

Under the rebate benefits option, Class Members are eligible for up to $10,000 in rebate if they purchase a new Navistar Class 8 heavy duty truck. The amount they are eligible to receive depends on how long they have had the previous, affected vehicle.

Under the repair compensation option, customers are eligible for up to $15,000 to compensate for repairs already completed on their previous, affected vehicles.
