Bosch manufactured certain dishwashers with control panel labeling that quickly fades, preventing consumers from using them properly, a new class action lawsuit alleges.
The lawsuit claims the control panel labeling on 100-, 300-, 500- and 800-Series Bosch dishwashers fades “within a relatively short period of time after purchase and far shorter than the expected useful lifespan of the product.”
“Without the ability to see the control panel labeling, the dishwashers are impossible, or at least unreasonably difficult, to use for their intended purpose of safely and properly cleaning dishes,” the Bosch class action says.
Revitch wants to represent a nationwide and California class of consumers who purchased a 100-, 300-, 500- and 800-Series Bosch dishwasher for personal or household use during the last four years.
Bosch aware of dishwasher control panel defect, class action claims
Revitch claims the control panels on the 100-, 300-, 500- and 800-Series Bosch dishwashers contain numerous settings and buttons that are not intuitive to use.
The class action lawsuit argues further the manufacturer of the Bosch dishwashers, BSH Home Appliances Corp., knows the issue is widespread but has neither tried to fix the problem nor provided repairs for the defect under its warranty.
“Bosch knew the dishwashers were defective and would continue to fail prematurely after the warranties expired,” the Bosch class action says.
Revitch claims BSH Home Appliances is guilty of unjust enrichment and violating California’s Unfair Competition Law, Consumer Legal Remedies Act and Song-Beverly Consumer Warranty Act.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual, compensatory, statutory and/or punitive damages for himself and all class members.
Earlier this year, a Washington federal judge preliminarily approved a $2 million settlement that resolved claims certain Bosch microwaves and microwave/oven combinations contain control panel lighting that fades or becomes unreadable over time.
