A California federal judge has denied Zales’ attempt to dismiss a class action lawsuit asserting that the company does not honor its own warranty terms.
According to U.S. District Judge James Lorenz, the Zales customer who filed the class action sufficiently established that the jeweler had indeed violated its Zales Lifetime Diamond Commitment.
Zales asserted that the customer’s claims of false advertising should be dismissed, by stating that most consumers would not have been misled by the advertising around Zales’ terms of warranty.
However, Judge Lorenz determined that Zales had not sufficiently established that the claims should be dismissed because they provided insufficient documents to back up this argument.
Zales also argued that the customer who filed the Zales class action lawsuit lacked specificity in his claims. However, Judge Lorenz states that the allegations were specific enough, because the Federal Rule of Civil Procedure “requires only a short and plain statement of the claim showing that the pleader is entitled to relief, in order to give the defendant fair notice of what the claim is and the grounds upon which it rests.”
According to Judge Lorenz, the customer’s claims were sufficient to raise a right to relief above the level of speculation, asserting that all of the allegations in the complaint are true.
Judge Lorenz also said that the customer had sufficiently established that many reasonable consumers would have been misled by Zales’ warranty.
The Zales warranty class action lawsuit was filed by Gordon Lovette, who says that he purchased a diamond ring from Zales, doing business as Piercing Pagoda, in 2008.
At the time he bought the ring, Lovette says he also purchased a Zales Lifetime Diamond Commitment, which is a warranty for repair and replacement of the diamond, if the ring is brought in for semiannual inspections.
According to Lovette, he brought the ring in for inspection every six months, per the service terms. He says that in 2018, the diamond became loose in its setting, and he requested a free repair under the terms of his warranty. However, he was allegedly refused the service and was told that loose settings were only covered under an extended warranty.
Allegedly, Lovette was told that unless he “immediately paid to have the setting corrected, it was voiding [his warranty] because the diamond was loose in its setting.” The employee reportedly refused to “sign off on [Lovette’s] bi-annual inspection … because his diamond was loose in its setting.”
Lovette says that had he known that Zales would violate the terms of its own warranty, he would not have purchased the ring or would not have paid as much as he did for it. He claims that he and many other customers were financially injured by Zales’ practices.

Zales in Northlake in Charlotte always did my inspection and cleaning. Records in that store system. I moved to Texas and went to Zales for my usual inspection. I have a gift receipt for the ring from 2016. Fast forward to October 2022. Zales has no records of my purchase or my diamond bond number . When I have paperwork for purchase and a resizing paperwork for pickup.
My wedding ring is 14 months old and the diamond fell out. Sales said my inspection was due in May so warranty is void.
My wedding ring needs repaired i have a diamond pond since 2006 they closed are store in Wyoming, they are wanting to give me a refund instead of fixing my ring or send it in the mail a long way i ask if i could have it fixed here since we have no stores they have refused. I don’t want to put it in the mail. how do i get added to this law suit. I have lot of jewelry from them i so upset.
I have a lot of Jewelry from Zales with warranties they refuse to take care of me my wedding ring needs fixed and they said they have no store near me the will not pay for me to take it to my jewelry store in town to have it fixed.
Please add me. My jewelry is falling apart and I’m supposed to have a lifetime warranty but they won’t honor it I have all the paper work.

Zales told us multiple times that inspections were being automatically renewed during covid and despite going in anyway they wouldn’t sign our paperwork. Today they told us we owed them money because our paperwork wasn’t brought in/up to date and we were no longer in their system.
I recently have had the same situation on an $8k wedding ring. I was told that all fees would be waived, my ring fixed, reset, tightened, cleaned, and my ring would be shipped to my home address (during which an additional wedding band was purchased at over $4k). That ring required resizing so both wedding rings were supposed to be shipped to us by the end of the month. Now, we have been getting constant calls saying that we owe additional money, our rings will not be shipped. Payment is due at the time of pickup and if we do not travel back to the store to pickup, then we will be forfeiting any rights to our jewelry. Despite all agreements and promises being in writing and documented by a sales clerk with a witness, due to distance we reside from that location (over 300 miles)… nothing we were told and promised will be honored. The lifetime guarentee and diamond bond purchase definitely feels like a scam because the company and employees will not honor it and develop ways to break/void it unknowingly to the customer. There seems to be no consumer protection to prevent this.
I have been taking my rings in q 6 months with the exception of when they were closed for Covid. I have somehow either lost the paperwork to my wedding rings or left it at the store. But I have been taking my jewelry and paperwork to same store for 5 years to be checked. Currently there is nothing wrong with my rings and have been told I didn’t need the paperwork anymore because they were all kept in the computer . I have also been told they purge their system every 5 years so if you don’t have the paperwork and you aren’t in the system you are screwed. Yesterday discovered that I have been blindly trusting them checking my rings and that I didn’t have the paperwork. All this time they have been using a different diamond bond number from another piece of my jewelry as my wedding rings. Customer service per the store- does not have a record of the purchase 9 years ago. Also told every store does something different. What a cluster. We also stopped I. On one occasion and was told my husbands rings were not in the system but fortunately I had the paperwork at home. Getting a very bad taste for ZALES and now will have to call customer service myself
My husband and I bought our wedding rings there ..zales was the only store he used ..he bought me a 4 CT tennis bracelet and 1 ct diamond earrings and a family tree necklace with birthstones and an anniversary ring that is 2 cts ..they were all bought between the years of 2001 to 2007 ..now the all either lost stones or need repairs to them n im told I need to pay 469 fir 3 pieces to be repaired because they didn’t have any of our lifetime warranty or diamond bonds .do they won’t cover anything …its not my fault something happened on thier end to loose everything that was ever bought thru them n now j havd to pay 469 to get my jewelry repaired…its just wrong
I worked for Zales for a few years and the only way that they cover missing diamonds is if the items are brought in every six months for an inspection. That way they know if something is coming loose before it falls out.
Please add me as well. My husband bought my engagement ring and bands in 2005. I went religiously for the first few years due to the stones constantly falling out and needing replaced. Then I misplaced paperwork and went for inspections and cleanings regularly and the store said no problem bring paperwork when I could. I found it and took rings in to have them resized and now they say i am unable to get them sized or “loose stones” tightened unless I pay $335. Why would I need to purchase a new warranty when my husband had done that when he purchased the original lifetime warranty.
