The Chico’s fake sale class action lawsuit was filed by Jackie Fisher, who says he purchased two shirts from a Chico’s outlet store in California.

Fisher claims that he purchased the shirts in part because they were offered on sale, and listed a reference price for what the shirts normally cost.

The Chico’s class action states that the references prices led him to believe that he was getting a good deal on the shirts. The tags reportedly led him to believe that he was purchasing items that had once been offered at the Chico’s retail stores at full price.

The Chico’s fake sale class action lawsuit argues that in reality, the shirts had never been offered for sale at the reference price that was listed on the tags, especially not within 90 days proceeding Fisher’s purchase.

The Chico’s false reference price class action lawsuit argues that Chico’s intentionally misled consumers into believing that the items were once offered at a higher price to lead them to believe that they were getting a better deal than they were.

Allegedly, Chico’s understands that customers are attracted to sales because they believe that the items they are attempting to purchase have a higher value than their current price, and that they are getting a more valuable item for their money.

Fisher says he was financially injured and misled by Chico’s conduct because had he known that the shirts he bought had not previously been offered at that higher reference price, he would not have purchased them or would not have paid as much for them as he did.

The fake sale class action lawsuit claims that many consumers were similarly misled by Chico’s conduct, and were similarly financially injured by the company’s actions.

Allegedly, many consumers only rely on the representations made by a company about the price and value of their products, and do not have another way of determining what the value and price of items are.

Fisher argues that part of the fake sale deception is that Chico’s leads consumers to believe that items at outlet stores are comparable to items offered at retail stores, and that they are getting a steep discount on items of higher quality offered at retail stores.

However, Fisher asserts that in reality, Chico’s produces Chico’s branded merchandise that is never sold at retail stores and goes straight to outlet stores.

Allegedly, this clothing is of a lesser quality, which is why it is offered at a lower price than regular Chico’s clothing and other items.

Fisher has also recently filed a similar lawsuit against Eddie Bauer.

The plaintiff is represented by Todd D. Carpenter of Carlson Lynch LLP.

    I started out a huge Chico’s fan and have spent plenty of hard earned money on what used to be quality attire. It’s difficult to have to accept, however my experience for approximately the past two years now is the quality of their clothing simply has not been worth the prices and it’s been a worse experience with Chico’s Off The Rack attire. Discontinuing certain items is one thing but poor replacements is another.

    Case without merit. Well known fact that most Outlets have their own clothing line now, including Chicos. It’s like ignorance of the law doesn’t mean your not guilty if you break the law. Think you will lose this battle.

    I have shopped at both places for as long as each has been in existence. Originally, the outlet did carry leftover or returned Chicos clothing. It then changed to a store that carried made for outlet merchandise. Even the labels in the retail store and outlets are different. No sales person in an outlet has ever implied to me that the clothing being sold was from the regular Chicos store. This man just wants to cause trouble. Eddie Bauer, Talbots and J.Crew all have outlet only merchandise too. This class action will go nowhere….nor should it!

    When they created the outlet shopping, it was overstocked regularly priced goods. Years later items were manufactured for their outlet stores! Nothing new hear! (I worked long ago for a manufacturer when this became mainstream)

    Both my husband and I worked at the distribution/outlet center in Georgia…THE WORST PLACE TO WORK EVER!!! The “management” is horrendous and literally treat their associates more like cattle than humans. They cut corners and costs like they’re Edward Scissorhands ✂ Chico’s stinks!!!

    I have been told by employees in the outlet stores that the clothes they sell are made specifically for the outlets. They have never been in a regular Chicos.

    I have shopped at both Chicos and Chicos Outlet. They are different merchandise. What is sold at their regular store is not sold at their outlet. He’s full of crap.
