Amazon, Cartier, Counterfeit Jewelry Complaint Overview:

Amazon and Cartier have jointly filed trademark infringement complaints against a group of Chinese entities and a social media influencer they claim sell counterfeit Cartier jewelry online.
Amazon and Cartier jointly claim the Chinese entities and a social media influencer from Handan, China, use social media and multiple Amazon stores to sell cheap counterfeit Cartier jewelry.
The accused counterfeiters go by the social media handle “Phym9y3v” and sell a number of trademarked items, including Cartier’s popular gold “LOVE” bracelets, according to the complaints.
Amazon, Cartier say counterfeiters attempt to evade detection
Amazon and Cartier claim the alleged counterfeiters use Instagram and Linktree to advertise the sale of real Cartier jewelry before linking consumers to an Amazon storefront where it states the items for sale are “non-branded” to evade Amazon’s counterfeit detection tools.
“Defendants engaged in a sophisticated campaign to market, advertise and sell counterfeit Cartier products in the Amazon Store while disguising the products as non-branded in an attempt to evade Amazon’s counterfeit detection tools,” Amazon and Cartier say in the lawsuits.
The jewelry items consumers purchase, however, are counterfeit yet contain Cartier trademarks as the social media accounts originally advertised they would, according to the complaints.
Amazon and Cartier claim the alleged Chinese counterfeiters are guilty of false advertising and trademark infringement and in violation of the Washington Consumer Protection Act.
The plaintiffs ask for injunctive relief along with general, special and actual damages.
Last year, Tiffany & Co. ended a complaint against Costco alleging it sold counterfeit Tiffany engagement rings following eight years of litigation.
