This asbestos lung cancer lawsuit was filed by a man from Arizona, who alleges his disease was directly caused by exposure to the fibrous substance.

Plaintiff Francis K. filed this asbestos lung cancer lawsuit not long after being diagnosed with the disease after his doctor determined that asbestos fibers were most likely the cause. According to the asbestos lung cancer lawsuit, Francis was first exposed to asbestos in 1953 when he started working in different shipyards.

More specifically, Francis says he worked for the United States Navy from approximately 1953 to 1974, working on nine different ships as a machinist mate. According to the asbestos lung cancer lawsuit, one of the shipyards Francis worked at was the Brooklyn Navy Yard, where he had various occupational duties.

After his time in the United States Navy, Francis says he worked at the Eastman Kodak Facility in Rochester, N.Y. from approximately 1974 until the mid 1990s.

In addition, Francis says he also worked at the Motorola plant from the mid-1990s until an unspecified year. Francis then worked at the Palo Verde Nuclear Power Plant in Tonopah, Ariz. until 2004. He says hewas not aware he had been exposed to asbestos throughout his entire work career.

According to the asbestos lung cancer lawsuit, he was diagnosed with the disease in August 2018.

Overview of Asbestos Lung Cancer

Lung cancer can be caused by a number of different factors, including personal habits like smoking, but this can also include environmental factors like asbestos. While Francis says he did smoke through his adult life, he quit in 2000. He says that medical records did show that his lung cancer was most likely caused by asbestos exposure.

According to the asbestos lung cancer lawsuit, medical records stated that there were calcified pleural plaques and extensive asbestos plaques in the lungs. It is important to note that asbestos lung cancer often takes up to 35 years to develop to the point where patients experience symptoms, often resulting in late diagnoses and limited treatment options.

Francis’ medical records indicated there was metastatic buildup in his glands and spine, which means the cancer has most likely spread to different parts of his body.

Asbestos is a fibrous material that was popularly used for almost every application in the manufacturing industry before the 1980s, for its fire and chemical resistant properties. However, the Environmental Protection Agency (EPA) started warning against the dangers of asbestos exposure in the 1980s.

When asbestos fibers are released into the air, they can either be inhaled or swallowed and allows them access to the respiratory system. When the fibers become lodged in the lungs, they can cause scarring and uncontrollable cell reproduction.

Due to the severity of health complications associated with asbestos exposure, the EPA has implemented strict regulations regarding asbestos use and removal.

Manufacturers must provide disclosures to customers and employees if their products contain asbestos, with employers required to provide protective equipment. Francis alleges CBS and the other manufacturers failed to do this, even though he was exposed to asbestos on a regular basis.
