Although autodialer calls (or robocalls) are against the law, many businesses continue to use them, banking on the fact that most consumers do not know these calls are illegal. Even when consumers are aware that businesses shouldn’t use autodialer calls, they often do not know what they can do about it.

As consumers become gradually more aware about autodialer calls, more and more people are coming forward with allegations of TCPA violations against businesses across the United States—some from major companies.

Reporting TCPA violations can lead to you—and sometimes thousands of others—receiving a substantial monetary award. Rewards for TCPA violations are based on the number of violations rather than actual damage against a consumer.

TCPA Background

The Telephone Consumer Protection Act, or TCPA, was first introduced in 1991. The TCPA was intended to protect consumers from unwanted solicitation through technology. The main focus of the TCPA was on autodialer calls, also known as robocalls.

Autodialer calls are made using an autodialing system or a pre-recorded messaging system. The TCPA bans the use of these autodialer calls to contact consumers who have not already given their explicit permission to receive such calls.

The TCPA has changed a little over the users, shifting as technology has advanced. New technologies (such as cell phones) have caused the TCPA to expand over the years, and now includes text messaging on top of the autodialer calls consumers have become used to.

If you have not given your prior express permission to receive these kinds of autodialer calls and texts, even if you are not on the National Do Not Call registry, you may be able to report these calls as TCPA violations, and you may receive some compensation in exchange.

Reporting TCPA Violations

Reporting violations of the TCPA or filing a TCPA lawsuit over unwanted autodialer calls can help force companies to comply with TCPA rules. Reports of these violations may also award consumers with a set amount of award money per individual violation.

Persistent autodialer calls are a common issue in the U.S. In fact, the FCC received more than 215,000 individual TCPA complaints in 2014 alone.

If you have received unwanted autodialer calls from a company without having given prior express permission, or after placing your name on a federal Do Not Call telemarketer list, you may be able to report these violations and receive compensation per violation.

A company that makes unwanted autodialer calls or texts in willful or knowing violation of the TCPA may be subject to higher fees than those who did so unknowingly.

For instance, a call simply violating the TCPA can entitle the plaintiff to $500, but a violation made in willful or knowing violation of the TCPA can increase that award to up to $1,500, or triple the original award.

A TCPA class action lawsuit involving thousands or even hundreds of thousands of consumers can force a company to pay a huge fine or settlement amount.

In order for your TCPA claims to be most effective, you will need proof of these violations. Keep messages and phone records of the autodialer calls and texts placed to your phone.

    every day I get calls even after adding my # to the do not call list. It’s ridiculous that I can’t answer my phone anymore unless I know who is calling! That’s a fact. I always miss important call’s that I have to call back if they leave a message like Hospital billing, business in general. It’s 2023 and I pay a lot of money for a one way phone in USA. Where is the consumer protection. This is Bull s#I&t! These companies should pay our phone bill’s for the rest of our lives.
