comcast class action settlementThe nation’s largest provider of broadband and Internet services has consumers initiating legal action over its allegedly “worthless” Comcast TV Service protection plan.

At least two lawsuits against Comcast allege that the cable company sold deceptive Comcast TV service protection plan packages that promised to cover repairs to interior wiring connected to internet or television equipment.

One of these lawsuits, filed in Missouri federal court, says that Comcast subscribers were charged a monthly $5 fee that purported to pay costs associated with service calls to repair wiring issues, but covered next to nothing in practice.

According to the Missouri lawsuit, Comcast promoted the the Comcast TV service protection plan as a single-fee program that would cover all service calls, including those that involved in-wall wiring.

However, the company allegedly failed to disclose that any work on “wires concealed within walls requiring wall fishing” was excluded, an exception the lawsuit says meant customers would still have to pay for most in-wall service calls.

Another Comcast lawsuit brought by the Washington state attorney general’s office in August claims Comcast deceived subscribers when marketing what the state calls “near-worthless” service plans.

Specifically, since January 2011, Comcast made $73 million selling Service Protection Plans for up to $5 a month to 500,000 customers in Washington.

But the Comcast TV service protection plan packages were sold to customers under false pretenses, with Comcast describing the plans as being far more comprehensive and useful than they were, Attorney General Bob Ferguson alleges.

This lawsuit seeks more than $100 million from Comcast.

Overview of Comcast TV Service Protection Plan

There are many complaints online about improper or unfair fees charged by internet service providers and cable service providers.

In regards to the Comcast TV Service Protection Plan, customers who sign up for the plan paid a $5 monthly fee ostensibly to avoid being charged if a Comcast technician visited their home to fix an issue covered by the plan.

According to a former website description of the Comcast TV Service Protection Plan at issue, Comcast claimed that the “comprehensive” plan covered the cost of all service calls, including those related to inside wiring, customer-owned equipment connected to Comcast services and on-site education about products.

However, Comcast did not appropriately disclose that the plan does not cover repairs to any “wall-fished” wiring — wiring inside a wall — which constitutes the vast majority of wiring inside homes.

While Comcast claims that these restrictions are in the plan’s terms and conditions, Comcast allegedly failed to provide those terms and conditions to its customers, and did not require customers to approve them nor did they tell customers that these additional terms and conditions existed.

A customer had to proactively search Comcast’s website to find these terms and conditions in fine print.
