The judge in charge of the class action lawsuit filed over Kohl’s credit card fees recently issued an order that gave the green light for the lawsuit to move forward.
For the Kohl’s credit card fees lawsuit to proceed, Plaintiffs Jennifer Gordon, Valerie Tantlinger, and Jennifer Underwood do not need to prove their case definitively.
Instead, they simply need to have provided enough evidence to a show a “reasonable likelihood” that continuing with a lawsuit will lead to proof of their claims.
The defendants were, for the most part, successful. The order grants the majority of the motions set forth in the plaintiffs’ class action lawsuit.
Some of the claims were dismissed, such as claims about fees incurred or paid prior to February 13, 2012 due to too much time passing.
Kohl’s Credit Card Fees Lawsuit Background
This class action lawsuit was filed against Kohl’s and Capital One in February 2015, claiming that its services Kohl’s Account Ease and PrivacyGuard are essentially worthless.
These services are officially a part of the store’s Payment Protection Plan, and were added in 2011. The plaintiff assert that they and other Kohl’s credit card holders were enrolled in these services as part of this protection plan without their permission.
According to the class action lawsuit, Kohl’s Account Ease is advertised as a service that allows Kohl’s customers to cancel their account balance under certain extreme circumstances. These circumstances include unemployment, disability, hospitalization, or death.
Privacyguard is a credit monitoring service.
In order to receive Kohl’s Account Ease, which was added automatically, customers were required to pay Kohl’s credit card fees of $1.60 per $100 spent in a month. PrivacyGuard cost $14.99 per month.
While these services were purportedly part of the Kohl’s Payment Protection Plan, disappointed customers claim that neither service provided any real service at all.
Customers who attempted to file a claim for Kohl’s Account Ease benefits were often denied their claims. Customers also claim that PrivacyGuard services were never provided as advertised.
Kohl’s and Capitol One attempted to have the claims of the Kohl’s credit card fees class action lawsuit dismissed back in March.
However, a Pennsylvania federal judge has allowed for the lawsuit to move forward. While some of the plaintiffs’ claims have been dismissed, claims about any fees from these service incurred anywhere in the last three years can continue on.

The class action lawsuit targets Kohl’s credit card fees, claiming that Kohl’s, along with Capital One, added useless services of no particular value to the plaintiffs’ store branded credit cards without permission.

UPDATE: On March 12, 2019, a $1.8 million settlement was proposed to resolve claims that Kohl’s and Capital One deceptively charged consumers for credit monitoring.
