Whole Foods Served Class Action Lawsuit Alleging Fake Vanilla Almond Milk Creamer

  • Whole Foods Market grocery store has been accused of duping consumers into thinking its creamer is flavored using real vanilla.
  • The plaintiff says she paid a premium for Whole Foods’ 365 Everyday Value organic almond milk coffee creamer, thinking it was made using real vanilla flavoring extracted from vanilla beans, based on the label.
  • She asserts the product label refers only to “natural flavors,” and does not disclose the vanilla flavor actually comes from added artificial vanillin.
  • The class action lawsuit argues that even if a consumer examines the back label, they wouldn’t know the creamer contains fake vanilla, in violation of consumer protection laws.

Express Clothing Retailer Texts Itself Into a Nationwide TCPA Class Action Lawsuit

  • A recent class action lawsuit alleges clothing retailer Express sends consumers “repeated and harassing telemarketing” texts.
  • The plaintiff claims she never told Express it could text her.
  • In addition, the company allegedly used prerecorded messages and automatic dialers to place calls.
  • The plaintiff sent a “STOP” text in response to one of the marketing text messages, she says, but received an additional 38 unwanted text messages.
  • The class action lawsuit seeks to represent a nationwide Cass of consumers who received unwanted text messages from Express between 2017 and the present.

Do You Qualify: Tire Recall Class Action Lawsuit Claim Review

  • Cooper Tire has recalled more than 400,000 tires from nine brands, according to the National Highway Transportation Safety Administration.
  • The tires come with an increased risk of sidewall separation, which could cause the tire to deflate rapidly and increase crash risk.
  • Brands such as Big O, Cooper Tire, Discount Tire, Les Schwab, Pep Boys’, and others are included in the recall. 
  • If one of these tires was installed on your vehicle while you were in a crash, you may be entitled to seek compensation.

W.B. Mason Accused of Price-Gouging on Fake N95 Masks, Nationwide Class Action Claims

  • A class action lawsuit accuses office supply company W.B. Mason of exploiting the COVID-19 pandemic by “preying upon” consumer fears to sell fake N95 masks at inflated prices.
  • Plaintiff Atlantic Coast Creations claims it purchased a box of 20 N95 masks from W.B. Mason that were labeled as though they were made by 3M. 
  • However, the masks were not made by 3M and have lot numbers indicating they are counterfeit, with the boxes stating they were made in Peru.
  • The plaintiff claims W.B. Mason misused the 3M trademark to deceive consumers, in addition to price-gouging; it allegedly charged nearly six times more than 3M charged for the authentic mask.
  • The class action lawsuit seeks to represent a nationwide Class of consumers who may have purchased a counterfeit, 3M-branded N95 mask from W.B. Mason during the pandemic.

Ten Auto Insurers Hit With Class Action Lawsuits Over Excessive Rates Amid Pandemic

  • Multiple class action lawsuits allege 10 major auto insurers — including State Farm, Geico, Progressive, and Allstate — failed to properly adjust rates to account for less driving and fewer wrecks during the pandemic lockdowns. 
  • The plaintiffs allege that though some insurance companies offered discounts during COVID-19 restrictions, those discounts didn’t account for the lack of driving and reduction in car accidents, which led to windfall profits for the companies.
  • Plaintiffs’ counsel says any discounts given were inadequate and rates should have been cut as much as 50 percent to 60 percent.
