XPO Logistics delivery class action settlement

Did you receive a post-delivery survey call after May 1, 2011 from XPO Logistics, Inc. regarding an Ikea delivery? You may be eligible to claim between $131 to $263 from a class action settlement.

Plaintiff Vincent Leung sued XPO Logistics in 2015 for allegedly placing unsolicited pre-recorded survey messages to consumers’ cell phones in violation of the federal Telephone Consumer Protection Act (TCPA). The TCPA was enacted by Congress in 1991 to prevent telemarketers from escaping state-law prohibitions on intrusive nuisance calls.

Leung alleges in the XPO TCPA class action lawsuit (Leung v. XPO Logistics) that the company not only violated the TCPA, but also caused Class Members actual harm “because they were subjected to the aggravation that necessarily accompanies these messages” and because they had to pay their cell phone service providers for using their phones to receive these calls.

XPO Logistics denies any wrongdoing but has agreed to a $7 million class action settlement to resolve the litigation and avoid the risk and cost of going to trial.

A federal judge conditionally certified the settlement class and preliminarily approved the XPO Logistics TCPA settlement on October 19, 2017.

Who’s Eligible

Class Members of the XPO TCPA settlement include all persons who received a pre-recorded post-delivery survey call after May 1, 2011 relating to an IKEA delivery, and whose telephone numbers are identified  in the call data produced in this litigation bearing the litigation production numbers XPOLG024550 and XPOLG024553.

Potential Award

$131 – $263 estimated.

The amount of money you could receive from the XPO TCPA class action settlement will depend on the number of valid Claim Forms submitted by Class Members.

It is impossible to determine exactly how much your award will be, but Class Counsel estimates that the amount of the cash award may be within the range of $131 to $263.

Proof of Purchase

Class Members will receive a Settlement Notice in the mail containing a Claim ID and PIN code, which must be used to file a claim.

    Yes it’s real. You had to file to be a class action member to begin with in order to receive the check. Scams don’t typically take over a year to write you a check.

    I just received my $99.62 check as well.
