Wireless Vision has agreed to create a settlement fund of $279,000 to resolve employees’ claims that the company violated the Illinois Biometric Privacy Act (BIPA).
Class members include all those individuals who scanned their fingers at a Wireless Vision location in Illinois between Jan. 29, 2015, and Jan. 29, 2020.
Wireless Vision operates more than 750 T-Mobile-branded and Metro PCS Division retail locations throughout the country, according to the company’s website.
Plaintiffs in a class action lawsuit alleged Wireless Vision violated BIPA by requiring employees to submit fingerprint scans for timekeeping without obtaining their consent to do so and without providing the legally required disclosures.
Wireless Vision does not admit any wrongdoing in response to these employee claims, but has agreed to the settlement in the interest of avoiding the continued costs and risks of litigation.
Class members are eligible to receive a proportional cash payment from the settlement fund based on how many class members submit valid claims for benefits. Class members are eligible to receive up to $900 from the settlement fund.
Up to 35% of the settlement fund has been allocated to cover settlement administration fees and attorneys’ fees. The two class representatives will receive $3,000 each for their role in the Wireless Vision BIPA class action lawsuit.
The deadline to opt out of the settlement, submit a dispute or file an objection to the settlement is Aug. 8, 2022.Â
Class members are invited to attend a final fairness hearing in the Wireless Vision BIPA settlement, scheduled for Sept. 19, 2022.Â
The deadline to file a claim in the Wireless Vision BIPA Settlement is Aug. 22, 2022.Â
