A $1.3 million settlement has been reached in a class action lawsuit alleging Lang Pharma Nutrition Inc., Wal-Mart Stores Inc., CVS Pharmacy Inc., Walgreen Company and Meijer Distribution Inc. misleadingly labeled their Coenzyme 10 (CoQ-10) supplements by overstating their effectiveness and their absorption rates.
If you purchased certain CoQ-10 supplements manufactured by Lang Pharma Nutrition from a Walmart, CVS, Walgreens or Meijer store, you may be entitled to benefits from the CoQ-10 class action settlement.
The products covered by this CoQ-10 class action settlement include:
- Walmart’s Equate Clinical Strength High Absorption CoQ-10 100mg
- CVS/Pharmacy Ultra CoQ-10 100mg
- CVS/Health Ultra CoQ-10 100 mg
- CVS/Pharmacy Enhanced Absorption Formula CoQ-10 100 mg
- CVS/Health Enhanced Absorption Formula CoQ-10 100 mg
- Walgreens Well at Walgreens CoQ-10 Enhanced Absorption Formula 100 mg
- Walgreens Well at Walgreens CoQ-10 Enhanced Absorption Formula 200 mg
- Meijer’s Ultra CoQ-10 100 mg
According to the Lang Pharma class action lawsuit, CoQ-10 is an antioxidant nutrient produced naturally in the the heart, liver, kidneys and pancreas. CoQ-10 reportedly has proven health benefits, but it is not soluble in water and is poorly soluble in fat.
“This is problematic for consumers who use CoQ-10 supplements because the body and digestive tract are aqueous, and the absorption of a substance depends on its first dissolving,” the CoQ-10 class action lawsuit states. “To address this problem, some dietary supplement manufacturers have invented technologies for modifying orally-administered CoQ-10 to increase its solubility, and thereby its bioavailability.”
Lang Pharma and the other retailer defendants allegedly marketed their CoQ-10 supplements as having high absorption properties, but the plaintiffs claim that laboratory testing shows that the CoQ-10 products fail to adequately dissolve and therefore provide little to no benefit to consumers. According to the CoQ-10 class action lawsuit, the defendants’ efficacy claims of “high absorption” or “better absorption” are false and misleading.
The CoQ-10 class action lawsuit asserts violations of California’s Unfair Competition Law, False Advertising Law and Consumer Legal Remedies Act, and for breach of express and implied warranties.
The defendants deny any wrongdoing and maintain the CoQ-10 products are effective and achieve the advertised absorption rates. They have agreed to settle the CoQ-10 class action lawsuit to avoid the time, expense and uncertainty of trial.
The CoQ-10 class action settlement was preliminarily approved on July 6, 2018.
In addition to offering cash payments and product credits to Class Members, the defendants have also agreed to make changes to their product labels and advertising of their CoQ-10 supplements.
Class Members who would like to opt out of or object to the CoQ-10 settlement must do so no later than Sept. 4, 2018.
Who’s Eligible
Class Members of the CoQ-10 settlement include anyone in the United States who purchased a CoQ-10 product manufactured by Lang Pharma and sold by CVS, Walmart, Walgreens and Meijer under store brand labels between July 1, 2013 and July 24, 2018.
Potential Award
Class Members who file timely and valid Claim Forms must choose between a $3.50 cash payment or a $12.50 product credit that can be used to redeem a variety of Lang Pharma products.
NOTE: These benefits may be increased or decreased depending on the total number of approved claims.
Proof of Purchase
None required. Class Members are asked to provide the approximate date of purchase, address at the store where the CoQ-10 purchase was made and indicate whether they want to receive a partial cash refund or a product credit.

I filed a valid claim and received nothing to date. :(
Has anyone else received 3 large bottles of CoQ10 from Lang Pharma? I didn’t order it so it has to be part of this settlement. I think it’s kinda weird.
Yes, I just got mine today. I thought I had checked/asked for a refund, so I was surprised to see them in the mail. The best part is, they have come in rather non-descriptive, generic “Plain Jane” wrapping, as if to hide the name of the company.
A proposed settlement has been reached in a class action lawsuit alleging violations of certain laws that prohibit misleading labeling and false advertising of CoQ-10 supplements. Defendants deny all of these allegations. The Court did not rule in favor of Plaintiffs or Defendants. Instead, because of the complexity and uncertainty of litigation, the parties compromised and negotiated a proposed settlement in order to avoid the expense and risks of continuing with the lawsuit. The court has preliminarily approved the proposed settlement.
