  • On Feb. 13, 2019, a $58 million settlement was reached to resolve class action allegations that All Nippon Airways engaged in a price-fixing scheme on transpacific flights.

A near $50 million Transpacific Airlines class action settlement has been expanded to include four more airlines.

If you purchased a plane ticket between Jan. 1, 2000 and Dec. 1, 2016 that included a flight that started in the United States and flew to Asia or Oceania, you may benefit from the Transpacific Airlines class action settlement.

The Transpacific Airline antitrust class action lawsuit alleged that dozens of airlines entered into a price-fixing scheme affecting consumers who wished to fly between the U.S. and Asia or Oceania. Originally, the plaintiffs claimed that the airlines also fixed prices for flights for Australia, New Zealand and the Pacific Islands.

In 2015, eight defendant airlines agreed to pay nearly $40 million to end the Transpacific Airline antitrust class action lawsuit, including Air France, Cathay Pacific, Japan Airlines, Malaysian Airlines, Qantas, Singapore Airlines, Thai Airways, and Vietnam Airlines.

Recently, Air New Zealand Limited, China Airlines Ltd., EVA Airways Corporation, and Philippine Airlines Inc. have agreed to settle the Transpacific Airline antitrust class action lawsuit. In total, they have agreed to pay $49.9 million, with EVA agreeing to pay $21 million and China Airlines paying $19.5 million to end the litigation.

One airline, All Nippon Airways, has not yet agreed to settle the Transpacific Airline antitrust class action lawsuit.

The Transpacific Airline antitrust class action lawsuit alleged that the airlines conspired to hike airfare, as well as surcharges, on these international flights as a way to artificially inflate the prices as well as their profits.

The additional four airlines that agreed to settle the Transpacific Airline antitrust class action lawsuit do not admit any liability under the terms of the settlement.

The deadline for Class Members to opt out or exclude themselves from the settlement is Aug. 30, 2018.

Who’s Eligible

Class Members include those who purchased flights from Air New Zealand Limited, China Airlines Ltd., EVA Airways Corporation, or Philippine Airlines Inc. from Jan. 1, 2000 and Dec. 1, 2016. The flights must have included a segment that originated in the U.S. and flew to Asia or Oceania.

$8.50 per eligible ticket claimed.

      It says 21 days to submit update on distribution to the court. Hopefully they will have it distributed, but they can say they need more time to the court, which is common practice for this administrator. Hoping for the best.

        ACTUALLY IT WAS SIGNED OFF ON 02/03/2022 BY THE US DISTRICT JUDGE TO RELEASE FUNDS AND HAVE 21 DAYS DO SO AND HAVE TO REPORT AFTER THAT TIME ON THE ACCOUNTING OF THOSE FUNDS.

      Don’t hold your breath on getting distribution checks within 21 days. Seems like legal jargon. Any communication from the settlement administrator would be appreciated. If the broke the calculator tell us, someone would probably loan them one for awhile. Feb 25 may be another court appearance to say they need more time to count. After 7 years you would think someone has a file by now that they could download to print 62K recipient checks in a matter of hours.

        Fred, you are SPOT ON. There is no logical reason that they could not have had the checks ready to print once the order was signed. Years and Years have passed. Final Distribution letters sent out in August. However, sadly, I can see the administrator asking for an extension instead of filing a post-distribution brief.

        Fred, they do have your checks ready. Didn’t you get the letter that summarized your claims and how many of which airlines you qualified for? My letter is dated 24Aug21. On it it listed every airline, every settlement and if you look on the court documents you will see how much every airline and every claim is worth. According to my calculations it will be approx. 2293.45 Japan air and Satogaeri settlements paying the most. You have to do some homework! And if the judge says 21 days and Rust consultants have to come back to court to show the distribution list you better believe it will be 21 days! Federal judges aren’t your local bench judges.

          But courts do accept request for extension. Even at the federal level. Why would you expect this to be with out further daily. As I said with today’s technology printing checks is a quick process if they have the ability and want to do it expeditiously. March 2nd is mysteriously the day I predict that the checks will mail out.

    Objection filed to delay distribution by financial recovery strategies, a mass claims filing service. So more delays. Ugh

      Tony, Could you please give us some more info? How did you discover this Objection? Is there a site we can access further information?

        You can find it on Pacer. It’s an objection to the motion to distribute regarding 82 people. The administration has responded to the objection.
        The Judge took the motion off calendar for February 11th and will rule on the briefs. Hopefully the judge rejects the objection or we are in for another long wait. Not great news.

          Thank you, Dan. How will we discover if the Judge has rejected the Objection? Any idea of how long timewise it’ll take for Judge’s decision?

            We will just have to keep an eye on Pacer to see the Judge’s decision. Hopefully not more than 30 days, hard to know.

          Thanks for clarifying, Dan. I attempted to get registered on Pacer to view, however, the fee schedule is unclear to me. I didn’t input my CC info as it said that was not required, but then it said I needed to wait for an activation token in the mail, or for instant access, a CC is required. Would I be charged based on the number of pages the motions are? Or how many searches I do? I’m confused…

            You are charged by the number of pages of the document you download.

          And if I view under 300 pages, then my pacer account won’t be charged?

      Which means 1) more delays and if the judges approves the objection 2) reduced payments (because claims admin estimates it’ll cost almost half million to process the claims in question & all late claims outside of the objections too) So let’s hope the judge sticks to the settlement claims bar date and deny the motion asap.
