UPDATE:
- On Feb. 13, 2019, a $58 million settlement was reached to resolve class action allegations that All Nippon Airways engaged in a price-fixing scheme on transpacific flights.
A near $50 million Transpacific Airlines class action settlement has been expanded to include four more airlines.
If you purchased a plane ticket between Jan. 1, 2000 and Dec. 1, 2016 that included a flight that started in the United States and flew to Asia or Oceania, you may benefit from the Transpacific Airlines class action settlement.
The Transpacific Airline antitrust class action lawsuit alleged that dozens of airlines entered into a price-fixing scheme affecting consumers who wished to fly between the U.S. and Asia or Oceania. Originally, the plaintiffs claimed that the airlines also fixed prices for flights for Australia, New Zealand and the Pacific Islands.
In 2015, eight defendant airlines agreed to pay nearly $40 million to end the Transpacific Airline antitrust class action lawsuit, including Air France, Cathay Pacific, Japan Airlines, Malaysian Airlines, Qantas, Singapore Airlines, Thai Airways, and Vietnam Airlines.
Recently, Air New Zealand Limited, China Airlines Ltd., EVA Airways Corporation, and Philippine Airlines Inc. have agreed to settle the Transpacific Airline antitrust class action lawsuit. In total, they have agreed to pay $49.9 million, with EVA agreeing to pay $21 million and China Airlines paying $19.5 million to end the litigation.
One airline, All Nippon Airways, has not yet agreed to settle the Transpacific Airline antitrust class action lawsuit.
The Transpacific Airline antitrust class action lawsuit alleged that the airlines conspired to hike airfare, as well as surcharges, on these international flights as a way to artificially inflate the prices as well as their profits.
The additional four airlines that agreed to settle the Transpacific Airline antitrust class action lawsuit do not admit any liability under the terms of the settlement.
The deadline for Class Members to opt out or exclude themselves from the settlement is Aug. 30, 2018.

Emailed the Settlement Admin (4/10/24)
“ Is there any update or updated expected timeline given the latest appeals ruling of February?”
Their answer:
“ The Settlement Administrator does not have any update to provide regarding the second distribution. When new information becomes available, it will be updated on our website, AirlineSettlement.com.
Update posted 2/27/24 on the settlement website
Court docket entry – Memo Affirming Courts Ruling authorizing 2nd Distribution
If I read correctly, it seems that the only recourse left for the appellants now is to file a writ with the Supreme Court — and as we know there is no mandate the SCOTUS accepts the case and statically they accept very very few.
So, just from a short read online, it looks like there’s really no more avenues for appeals as the District Court of Appeals as affirmed the earlier ruling District Court ruling that the 2nd distribution to go ahead and to deny a claim of an apparent dubious nature. Let’s hope we see a second check soon!
Any Update on this one?
It looks like there is about $5.4M left with about $500k going to Counsel. The second distribution will be very small compared to the first. But I’ll be thankful for any that I hopefully will receive.
Per Rust Consulting 7/13/23 Appeals remain unresolved pending the Court.
Does anyone know if they did indeed do a second distribution?
No. Not yet. Naturally there are appeals – notably by one class member – and until those appeals are fully exhausted, the administrator can’t payout or issue any funds. Unfortunately, there’s no way to know when the court will rule and if not in favor of the appellant, what further court remedies are possible or open to them.
I contacted the settlement admin to request my check to be reissued since it was passed the expiration but they told me there is an objection to the judge’s ruling on secondary distribution.
1/19/23 Update
The judge signed the order authorizing plaintiff’s motion for second distribution (reference court document on official settlement administration webpage)
What is secondary distribution in simple terms?
Essentially it is taking all the “left over” money that wasn’t claimed people in the first round – and pooling it up and a second round of checks is issued to hopefully fully distribute all the money.
but until all appeals by claimants are addressed by the court, the administrator can’t issue any checks to anyone.
Objection was filed on the motion for a second distribution; it is currently pending court ruling.
Wondering what happened at the October 28th hearing for 2nd distribution??
Nothing posted to the website!
A court hearing is scheduled for Oct 28 2022 @ 10am
