TitleMax privacy settlement

A settlement has been reached in a class action lawsuit alleging TitleMax of Texas Inc., which provides title loans to consumers, illegally obtained private information about consumers from the Texas Department of Motor Vehicles.

If your name and address were obtained by TitleMax from a Texas motor vehicle record, you may be entitled to a cash payment from the TitleMax class action settlement.

Plaintiff Dexter Sistrunk alleges TitleMax employees violated the federal Driver’s Privacy Protection Act by obtaining consumer information including names, addresses and vehicle information from the Texas DMV.

“Beginning in the summer of 2012, Defendants began engaging in a pattern of accessing state motor vehicle records to obtain information about consumers who had previously obtained title loans from other companies for purposes of marketing its services to these potential customers,” the TitleMax class action lawsuit says.

TitleMax allegedly used this information to contact consumers, without their consent, in order to solicit future business. Obtaining this information for the purpose of soliciting new customers constitutes a violation of the DPPA, according to the TitleMax class action lawsuit.

The defendants deny the allegations but agreed to settle the TitleMax class action lawsuit to avoid the uncertainty and expense of ongoing litigation. The TitleMax class action settlement was preliminarily approved on Oct. 25, 2017.

The deadline to opt out of or object to the TitleMax class action settlement is Dec. 22, 2017.

Who’s Eligible

Class Members of the TitleMax settlement include anyone whose name and address were obtained by the TitleMax defendants from a Texas motor vehicle record, through searching PublicData.com and/or DataTrax websites.

Proof of Purchase

Class Members must file a valid Claim Form that includes all of the required information. Class Members must also submit a signed substitute IRS Form W-9 with their tax identification number and a copy of their government-issued photo ID card.

    Contact the TX OCCC *AND* the CFPB….both are responsible for government oversight of the lending and collection practices of Loan Star Title Loan.

    They are in Missouri and like said a 3200 dollar loan will cost you 15,000 to pay the term of the loan i have been paying 440 a month and loan pay off never goes down

    Title Max in Ohio I have enough paper work to provide for a Case my Case of being threatened with holding my title after pay off because they wanted me to sign a new contract because another business bought them 2 months prior I know I’m not the only one as I’ve witnessed others signing up I didn’t n the charged me a late pay off because I didn’t sign new documents I paid off last year 5/17 n I just got my title back 3/27/2018 I need an attorney don’t know who to call what type of Attorney do I look for any help ? Please I have all documents n cell phone records of being called as much as 3x a week after information them to quit calling my cellphone number they have my house number

    My friend is paying $260.00 a month . $193.00 is interest and $67.00 goes to principle. She is a senior only gets $1100.00 a month to live on. By the time the $1800.00 ‘she borrowed will wind up being $7,000.00. Her car is worth $1,500.00. CROOKS

    I got a title loan through Loan Star title aka integrity Texas funding. They repossed my car I made 850 payments four times and I went in to pay what I thought was going to be my last payment. I had 1900 and come to find out only 300 .00 out of all the money I paid in was towards the principle. I am sick, I honestly did not realize that I had to pay all those high monthy payments and the last payment was supposed to be 3,00.00 and if you don’t have that whole amount they will refinance you again. Please help me. Texas

      I just saw your post I had A Similar problem with Loan Star Title Here in Texas They kept Me Paying on interest I’m Where’s The money for The Principal going any I got fed up this was 2014 I can’t find the Papers But anyway Look at your Loan Papers There is A Clause that talks about How to get help or dispute Contract etc. it’s A Number in Austin Texas contact them or LongStar Legal Aide on what to do they have free Attorneys.
