The makers of Testofen have agreed to pay $7 million to settle a class action lawsuit alleging the nutritional supplement was falsely advertised.

The Testofen marketing claims class action lawsuit alleges that the supplement, included in various products sold by a slew of defendants, was advertised as a natural testosterone booster.

The Testofen class action lawsuit says that consumers were duped by marketing claims that the products were clinically tested and proven to offer a number of benefits, including “improved orgasms, improved cognition, the promotion of fat loss, heightened libido, enhanced sexual performance, strengthened blood flow, promote or build muscle mass, [and] improved power and/or stamina.”

However, these marketing claims were not backed up, according to the Testofen marketing claims class action lawsuit.

The defendants in the class action lawsuit include Gencor Nutrients Inc. (Gencor); PharmaFreak Holdings Inc.; Force Factor LLC; Dreambrands Inc.; General Nutrition Centers Inc.; General Nutrition Corporation; GNC Corporation; S&G Properties LLC; KingFisher Media LLC; Direct Digital LLC and Prevention LLC d/b/a Naturade.

Under the terms of the Testofen marketing claims class action lawsuit settlement, the defendants have agreed to pay various sets of Class Members between $1.99 and $14.52 per household. Additionally, the defendants have agreed to modify their marketing materials.

The deadline for Class Members to object or opt out of the Testofen class action lawsuit settlement is July 30, 2018.

Who’s Eligible

Class Members include those who received a trial offer or “purchased any Testofen® Products purchased between January 1, 2010 and May, 14 2018, including but not limited to: Troxyphen, Troxyphen Elite, Ageless Male containing Testofen, Test X180, Test X180 Alpha, Test X180 Ignite, Stack Factor 2 With Test X180, High T, High T Senior, High T Black, High T Caffeine Free, Mdrive, Mdrive Elite, Test Freak, PMD N-TEST 600, PMD Flex Stack, PMD Platinum Test 600, AMP Test 1700, NO2 Red Test, Ultra T Gold, Nugenix, Vitali-T-Aid, Vitali-T-Aid Energy, and Testoril.”

Potential Award

$1.99 to $14.52 per household depending on the purchase or trial offer received.

    Gencor website still shows the video claiming those false benefits they agreed to settle on. Is that legal?
