Safeway and Albertsons Cos. agreed to a $107 million settlement to resolve a class action lawsuit claiming they falsely advertised some products with “buy one get one” (BOGO) sales.
The settlement benefits consumers who purchased certain meat products advertised with a “Buy One, Get One Free” or “Buy One, Get Two Free” promotion at Safeway locations in Oregon using a Safeway Club Card between May 4, 2015, and Sept. 7, 2016.
Plaintiffs in the class action lawsuit accused Safeway of violating Oregon law by raising the price of meat products sold under “Buy One, Get One Free” and “Buy One, Get Two Free” promotions. By raising the prices above regular retail prices, Safeway allegedly deceived customers into believing they were getting a good deal while actually overcharging for the products.
Safeway is a grocery store chain owned by Albertsons Cos. The chain has locations around the country, including numerous locations in Oregon.
Safeway and Albertsons haven’t admitted any wrongdoing but agreed to a $107 million settlement to resolve the false sale class action lawsuit.
Under the terms of the Safeway settlement, class members can receive an equal share — estimated to be $200 — of the net settlement fund.
Exact payments may be higher or lower depending on the number of participating class members and the net settlement fund after deductions for expenses and other costs.
The deadline for exclusion and objection is June 16, 2023.
The final approval hearing for the Safeway settlement is scheduled for July 10, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by July 10, 2023.

UPDATE: On July 25, 2023, the Court entered a Final Order and Judgment approving the Settlement. On August 8, 2023, the Settlement Administrator sent an email to class members entitled to receive a settlement payment. Would have been nice to receive this before the cutoff date
The Oregon Safeway is not the only location that does this scammer business every Safeway I have been to has done that with all of their products almost not just me it’s ridiculous it’s been happening for years I’m in California we just got a new crocker Safeway and they’re also doing it too
The cashiers apparently have no idea what Safeway’s sales or club member policies are as I have been misdirected by them and paying much more for items than I should have otherwise. I can’t say if this is intentional but it has happened more than once.
The Safeway in Sweet Home Oregon is constantly conning it’s customers by not applying discounts as advertised they’re running a racket by up charging customers and making it impossible to get your money that is rightfully not theirs to take. And it’s one of the only places in town so options are limited.
