Safeway and Albertsons Cos. agreed to a $107 million settlement to resolve a class action lawsuit claiming they falsely advertised some products with โbuy one get oneโ (BOGO) sales.
The settlement benefits consumers who purchased certain meat products advertised with a โBuy One, Get One Freeโ or โBuy One, Get Two Freeโ promotion at Safeway locations in Oregon using a Safeway Club Card between May 4, 2015, and Sept. 7, 2016.
Plaintiffs in the class action lawsuit accused Safeway of violating Oregon law by raising the price of meat products sold under โBuy One, Get One Freeโ and โBuy One, Get Two Freeโ promotions. By raising the prices above regular retail prices, Safeway allegedly deceived customers into believing they were getting a good deal while actually overcharging for the products.ย
Safeway is a grocery store chain owned by Albertsons Cos. The chain has locations around the country, including numerous locations in Oregon.ย
Safeway and Albertsons havenโt admitted any wrongdoing but agreed to a $107 million settlement to resolve the false sale class action lawsuit.ย
Under the terms of the Safeway settlement, class members can receive an equal share โ estimated to be $200 โ of the net settlement fund.ย
Exact payments may be higher or lower depending on the number of participating class members and the net settlement fund after deductions for expenses and other costs.
The deadline for exclusion and objection is June 16, 2023.ย
The final approval hearing for the Safeway settlement is scheduled for July 10, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by July 10, 2023.

I made the same allegation with TCA several years ago regarding Albertsonโs BOGO meat and soft drink sales in California, but never heard back. They are still actively overpricing the Buy portion, so hopefully this can extend to other states.
Please add me. I was doing the BOGO, all the time, to save.

When you have a large family/ The BOGO was the draw for feeding the family but the deceptive pricing methods used makes me feel like I should have been smarter as always after the BOGO they seemed to change. Please add me and I will be submitting a form.
