Following a bankruptcy filing, consumers who were injured by OxyContin or other addictive opioids manufactured by Purdue Pharma may be able to recover compensation.

The claim program benefits individuals who were injured by Purdue opioids such as OxyContin before Sept. 15, 2019, or the families of minors or deceased victims.

In September 2019, Purdue Pharma declared bankruptcy after facing significant liability in OxyContin and opioid addiction lawsuits. Following their bankruptcy filings, Purdue launched a $23.8 million ad campaign in order to advertise a claims program.

Under the claims deal, Purdue will pay to resolve the claims in nearly 3,000 lawsuits alleging that their OxyContin and other opioid products were irresponsibly produced. Allegedly, the company downplayed the risks of their opioids and overstated the benefits.

As a result, hundreds of thousands of people have allegedly died over the past 20 years as part of the opioid epidemic in America.

“A lot of the victims don’t know that they were victimized. They may think that they’re addicts. They may think that they have a moral failing or a character failing,” Ed Neiger, a lawyer for opioid victims, told AP News. “There were people in a boardroom that caused them to become addicted to opioids.”

Although the amount that consumers can collect hasn’t been finalized, compensation may be available to injured parties. A Class Member’s payment will vary depending on the injury they suffered (death, addiction, dependence, lost wages, loss of wages, loss of spousal relationship, etc.).

In order to receive benefits from the settlement, Class Members must file a valid claim form online or through the mail by June 20, 2020. Class Members should include proof of any damages or injuries.

  5. MattE Brown says:

I’ve been on opioids since 99′..It’s cost me more than I could of imagined, including a self inflicted gun shot wound in 2005. I believed I missed the deadline to file a claim. Is there anything else I could do??

    1. Belew says:

Matt — Due to the enormity of this bankruptcy, there is a lot of disarray and confusion still. Just check back periodically. It is definitely possible that an additional claim window opens up.

  6. Belew says:

On 12/16/21, a New York federal judge has reversed the settlement with Purdue Pharma that granted the Sacker family, the owners of Purdue, immunity from all future opioid lawsuits in return for $4.5B of payment retributions. This is pretty much a “go back to square 1” decision in terms of the payments expected out of the bankruptcy courts which was the centerpiece of the discussion/comments in this class-action settlement thread over the last 24 or so months. If you thought there were delays before, now you will really have to wait.

  7. Diane and Timmie Howard says:

I am elderly and need some help after being addicted to Opioid addition. I am now on Methadone the problem is that I have to pay $14.00 a day for the dose and I am 66 on a limited income. My husband was snorting Opioids just to get relief from a back injury in the coalminers then a near fatal car accident in 2004. He is 63 and pays $14.00 a day for his Methadone which makes our income too small to pay our other bills and groceries. We have no hope for doing repairs on our home nor buying a vehicle when our used Van (2008 with 200,000 miles on it goes down). Along with these problems we find everyday life to be a challenge. It has made our life unbearable. What can we do? We hated to write this and beg for help but we have no way of getting help at this point in our life. Can you help since it is because of addiction of this Oyncontin has caused our problem and something should be for us to help elevate it because at our age we didn’t ask for this to happen to us? Now on top of everything else my teeth are falling out and you don’t realize how bad I feel with a mouth full of cavities, pure rotten teeth which will have to be pulled and I will probably have to get false teeth. I look forward to hearing from you or an someone who understands our situation.

Ask Llp successfully filed a claim for me as I have taken oxycodone and hydro for over 15 years. It took my respiratory therapy career away. I went through 5 divorces and lost several jobs as well as got a criminal record now. I’m worried about my claim qualifying though. I have no way of knowing who made the generic meds I took. I had several different looking versions of 15mg oxy and 10mg oxy and hydro but I don’t know who made them. If this firm accepted my claim and filed successfully does that mean that I qualify fir payment and a tiny bit of relief for a tragic life after taking this crap?
